    AN ACT concerning State government.
 
    Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
 
    Section 5. The Illinois Notary Public Act is amended by
changing Section 2-101.5 as follows:
 
    (5 ILCS 312/2-101.5)
    Sec. 2-101.5. Course of study and examination.
    (a) Except as required in subsection (c), applicants
Applicants applying for the first time as a notary public or as
an electronic notary public or applying to renew his or her
appointment as a notary public or as an electronic notary
public shall:
        (1) complete any course of study on notarization and
    electronic notarization that is required by the Secretary
    of State; and
        (2) pass an examination at the completion of the
    course.
    (b) The Secretary of State shall have the authority to
adopt administrative rules mandating a course of study and
examination and establishing the course of study content,
length of the course of study to be required, and to approve
any course of study providers.
    (c) Notwithstanding any other provision of this Section,
an applicant to renew an appointment as a notary public or as
an electronic notary public is not required to complete the
course of study or pass the examination required under
subsection (a) if the applicant submits, in the form and
manner prescribed by the Secretary of State, a signed
statement that the applicant (i) is a licensed attorney or
judge or is employed by a licensed attorney or the court and
(ii) has read and understood the version of the Act that is in
effect at the time of application.
