AN ACT to amend the Illinois Insurance Code by changing
Section 143.10b.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Illinois Insurance Code is amended by
changing Section 143.10b as follows:
(215 ILCS 5/143.10b) (from Ch. 73, par. 755.10b)
Sec. 143.10b. (1) Loss information, private passenger
automobile.
(1) All companies issuing a "policy of automobile
insurance" as defined in paragraph (a) of Section 143.13 of
this Code shall, on or after January 1, 1990, provide the
following loss information for the 5 three previous policy
years to the named insured within 30 days of the insured's
written request:
(a) on closed claims, date and description of
occurrence, and total amount of payments;
(b) on open claims, date and description of
occurrence and total amount of payments;
(c) for any occurrence not included in (a) or (b)
of this subsection, the date and description of
occurrence.
(2) If a company fails to provide the information as
required by this Section with such frequency so as to
indicate a practice of refusing to provide such information,
such failure shall constitute an unfair trade practice as
defined in Section 424 and subject to those hearing and
penalty provisions as set forth in Sections 425 through 434
of this Code.
