AN ACT concerning products with recycled contents.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 1. Short title. This Act may be cited as the
Recycled Content Products Study Act.
Section 5. Recycled Content Products Task Force.
(a) There is established the Recycled Content Products
Task Force. The Task Force shall consist of the following
members:
(1) the Director of Commerce and Community Affairs
or his or her designee;
(2) four members of the public appointed one each
by the President of the Senate, the Speaker of the House
of Representatives, the Minority Leader of the Senate,
and the Minority Leader of the House of Representatives;
and
(3) ten members appointed by the Governor as
follows:
(A) one member from a local solid waste
agency;
(B) one member representing a manufacturer
using recycled content in products;
(C) one member representing a nonprofit
recycling center;
(D) one member who is an executive of a solid
waste company;
(E) one member representing a recycling
processing company;
(F) one member representing a research
institution or an institution of higher education;
(G) one member representing consumer advocacy
groups;
(H) two members representing environmental
advocacy groups; and
(I) one member representing municipalities.
Appointments shall be made by October 1, 1999.
(b) The Director of Commerce and Community Affairs or
the Director's designee shall serve as chairman of the Task
Force. Members of the Task Force shall serve without
compensation, but may be reimbursed for their reasonable and
necessary expenses incurred in performing their duties. The
Department of Commerce and Community Affairs shall provide
staff and equipment necessary for the Task Force to complete
its duties.
Section 10. Task Force study.
(a) The Task Force shall study and assess the existing
market development for recycled content products in the
private and public economy. The Task Force shall compare
this market in Illinois with the markets in other Midwestern
states.
(b) The Task Force shall evaluate the desirability of
implementing market development approaches in use in other
Midwestern states, including, but not limited to, the
desirability of:
(1) creating a State Marketing Board to act in the
role of supporting market efforts for use of recyclables
in existing or new products and advising State and local
officials in recyclable marketing efforts;
(2) creating technical assistance programs,
utilizing universities and other research organizations,
designed to assist local governments and businesses with
incorporation of recyclables into product development;
(3) incentives through loans or grants to encourage
the use of recyclables in existing or new products;
(4) tax credits under circumstances when resource
commitment and product development goals have been met
through the use of recyclables; and
(5) establishment of a local zone program having as
its purpose the promotion of recycling manufacturing
businesses in cooperation with local governments.
"Local zone program" means a program designed to
compliment State market development and business assistance
efforts by offering additional services and incentives such
as fast track permitting, location incentives, and job
training assistance.
(c) The Task Force shall study methods for recycled
product promotion that create demand for the purchase of
recycled content products by:
(1) development of an ongoing, year-round
educational effort designed to promote understanding of
the economic desirability of the purchase and use of
recycled content products by government, business, and
individuals;
(2) promotion of the purchase and use of recycled
content products by State and local governments,
agencies, and authorities through procurement and
implementation policies and practices that require
outcome reports; and
(3) State participation in interstate joint
purchasing programs in a manner that enables units of
local government to participate in those programs.
Section 15. Report. The Task Force shall report its
findings and recommendations to the Governor and General
Assembly no later than July 1, 2000.
Section 90. Repealer. This Act is repealed January 1,
2001.
Section 99. Effective date. This Act takes effect upon
becoming law.
