SYNOPSIS AS INTRODUCED:
 
20 ILCS 2105/2105-60

    Amends the Department of Professional Regulation Law of the Civil Administration Code of Illinois. Requires (instead of allows) the Department of Financial and Professional Regulation to accept payment by credit card for any fee, fine, or other charge that it is authorized by law to collect. Requires (instead of allows) the Department to accept payment through a third-party payment agent of any fee, fine, or other charges to the Department.

1    AN ACT concerning government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Professional Regulation Law
5of the Civil Administrative Code of Illinois is amended by
6changing Section 2105-60 as follows:
 
7    (20 ILCS 2105/2105-60)
8    Sec. 2105-60. Payment by credit card or third-party
9payment agent.
10    (a) For the purposes of this Section, "credit card" has
11the meaning given to it in Section 10 of the Local Governmental
12Acceptance of Credit Cards Act.
13    (b) The Department shall may, but need not, accept payment
14by credit card for any fee, fine, or other charge that it is
15authorized by law to collect. The Department may adopt rules
16and procedures governing the acceptance of payment by credit
17card and may enter into such agreements as may be necessary to
18accept payment by credit card.
19    (c) The Department shall may, but need not, accept payment
20through a third-party payment agent of any fee, fine, or other
21charges to the Department. The Department may adopt rules and
22procedures governing the acceptance of payments through
23third-party payment agents.

1    The Department may enter into agreements with one or more
2financial institutions, internet companies, or other business
3entities to act as third-party payment agents for the payment
4of fees, fines, or other charges to the Department. These
5agreements may authorize the third-party payment agent to
6retain a service fee out of the payments collected.
7    (d) Receipt by the Department of the amount of a fee, fine,
8or other charge paid by credit card or through a third-party
9payment agent authorized by the Department, less the amount of
10any service fee retained under the Department's agreement with
11the credit card service provider or the third-party payment
12agent, shall be deemed receipt of the full amount of the fee or
13other charge and shall discharge the payment obligation in
14full.
15    (e) In the event of a conflict between this Section and a
16provision of any other Act administered by the Department,
17this Section controls.
