SYNOPSIS AS INTRODUCED:
 
415 ILCS 5/19.12 new
30 ILCS 105/5.1015 new

    Amends the Environmental Protection Act. Creates the State-funded Watershed Grant Program. Allows a person who has applied for a grant that is financed under a specified provision of the federal Water Pollution Control Act to obtain financial assistance to cover up to 50% of the 40% nonfederal match that the applicant is required to supply in order to obtain financial assistance for a nonpoint source project under the cited provision of the federal Water Pollution Control Act. Establishes the Watershed Protection Grant Program Fund as a special fund in the State treasury. Requires the Illinois Environmental Protection Agency to adopt rules to implement and administer the program. Amends the State Finance Act. Creates the Watershed Protection Grant Program Fund as a special fund in the State treasury. Effective July 1, 2024.

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Environmental Protection Act is amended by
5adding Section 19.12 as follows:
 
6    (415 ILCS 5/19.12 new)
7    Sec. 19.12. Watershed grant program.
8    (a) Subject to appropriation, the Agency shall create a
9State-funded Watershed Protection Grant Program through which
10a person who has applied for a grant that is financed under
11subsection (h) of Section 319 of the federal Water Pollution
12Control Act may obtain financial assistance from the Agency to
13cover one-half of the 40% nonfederal match that the applicant
14is required to supply in order to obtain financial assistance
15for a nonpoint source project under subsection (h) of Section
16319 of the federal Water Pollution Control Act.
17    (b) The Watershed Protection Grant Program Fund is created
18as a special fund in the State treasury. The Fund may accept
19appropriations and moneys from any other lawful source. Any
20interest earned on moneys in the Fund shall be deposited into
21the Fund. All moneys in the fund shall be used to provide
22financial assistance to cover one-half of the nonfederal 40%
23match the applicant is required to supply in order to obtain

1financial assistance for a nonpoint source project under
2subsection (h) of Section 319 of the federal Water Pollution
3Control Act or for the Agency's expenses in administering the
4Program.
5    (c) The Agency shall adopt rules to implement and
6administer the program created under this Section.
 
7    Section 10. The State Finance Act is amended by adding
8Section 5.1015 as follows:
 
9    (30 ILCS 105/5.1015 new)
10    Sec. 5.1015. The Watershed Protection Grant Program Fund.
 
11    Section 99. Effective date. This Act takes effect July 1,
122024.
