SYNOPSIS AS INTRODUCED:
 
30 ILCS 115/13.2 new
625 ILCS 5/12-705.1 rep.

    Amends the State Revenue Sharing Act. Requires the Department of Revenue to establish a payment, in excess to the Department's determined amount for the fiscal year, that is equal to 1% of a municipality's or county's allotment from the Local Government Distributive Fund to be awarded to any municipality or county that can document its use of diesel fuel containing in excess of the percentage of biodiesel necessary to qualify for exemption from the tax under specified provisions of the Use Tax Act for that year. Amends the Illinois Vehicle Code. Repeals a provision of the Code concerning the required use of biodiesel.

1    AN ACT concerning finance.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Revenue Sharing Act is amended by
5adding Section 13.2 as follows:
 
6    (30 ILCS 115/13.2 new)
7    Sec. 13.2. Biodiesel fuel incentive. For the sole purpose
8of providing an incentive to increase the use of biodiesel by
9municipalities and counties, the Department of Revenue shall
10establish a payment, in excess to the Department's determined
11amount for the fiscal year, that is equal to 1% of a
12municipality's or county's allotment from the Local Government
13Distributive Fund to be awarded to a municipality or county
14that can document its use of diesel fuel containing in excess
15of the percentage of biodiesel necessary to qualify for
16exemption from the tax under Section 3-5.1 of the Use Tax Act
17for that year.

19    Section 10. The Illinois Vehicle Code is amended by
20repealing Section 12-705.1.
