SYNOPSIS AS INTRODUCED:

625 ILCS 5/11-1435 new

Amends the Illinois Vehicle Code. Provides that a person or entity may not use an electronic tracking device to determine the location or movement of a person. Exempts from the new provisions (1) situations where the registered owner, lessor, or lessee of a vehicle has consented to the use of the electronic tracking device; and (2) the lawful use of an electronic tracking device by a law enforcement agency. Provides that a violation of the new provisions is a Class A misdemeanor.

AN ACT concerning transportation.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Vehicle Code is amended by adding Section 11-1435 as follows:

(625 ILCS 5/11-1435 new)

Sec. 11-1435. Electronic tracking devices prohibited.

(a) A person or entity in this State may not use an electronic tracking device to determine the location or movement of a person. As used in this Section, "electronic tracking device" means any device attached to a vehicle or other moveable thing that reveals its location or movement by the transmission of electronic signals.

(b) This Section does not apply:

(1) when the registered owner, lessor, or lessee of a vehicle has consented to the use of the electronic tracking device with respect to that vehicle; or

(2) to the lawful use of an electronic tracking device by a law enforcement agency.

(c) A violation of this Section is a Class A misdemeanor.
