AMENDMENT TO HOUSE BILL 4230

2    AMENDMENT NO. ______. Amend House Bill 4230 as follows:
 
3on page 1, line 9, by replacing "17" with "17, 45"; and
 
4on page 13, immediately below line 5, by inserting the
5following:
 
6    "(50 ILCS 751/45)
7    (Section scheduled to be repealed on July 1, 2014)
8    Sec. 45. Continuation of current practices.
9Notwithstanding any other provision of this Act, a unit of
10local government or emergency telephone system board providing
11wireless 9-1-1 service and imposing and collecting a wireless
12carrier surcharge prior to July 1, 1998 may continue its
13practices of imposing and collecting its wireless carrier
14surcharge, but in no event shall that monthly surcharge exceed
15$2.50 per commercial mobile radio service (CMRS) connection or

1in-service telephone number billed on a monthly basis. For
2mobile telecommunications services provided on and after
3August 1, 2002, any surcharge imposed shall be imposed based
4upon the municipality or county that encompasses the customer's
5place of primary use as defined in the Mobile
6Telecommunications Sourcing Conformity Act.
7    In addition to any other lawful purpose, a municipality
8with a population over 500,000 may use the moneys collected
9under this Section for any anti-terrorism or emergency
10preparedness measures, including, but not limited to,
11preparedness planning, providing local matching funds for
12federal or State grants, personnel training, and specialized
13equipment, including surveillance cameras as needed to deal
14with natural and terrorist-inspired emergency situations or
15events.
16    For surcharges collected and remitted pursuant to this
17Section on and after July 1, 2014, $0.02 per surcharge
18collected shall be deposited into the Poison Response Fund for
19distribution monthly to a human poison control center as
20defined in Section 10 of the Poison Control System Act.
