AMENDMENT TO HOUSE BILL 485

2    AMENDMENT NO. ______. Amend House Bill 485, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The State Officials and Employees Ethics Act is
6amended by changing Section 5-20 as follows:
 
7    (5 ILCS 430/5-20)
8    Sec. 5-20. Public service announcements; other promotional
9material.
10    (a) Beginning January 1, 2004, no public service
11announcement or advertisement that is on behalf of any State
12administered program and contains the proper name, image, or
13voice of any executive branch constitutional officer or member
14of the General Assembly shall be (i) broadcast or aired on
15radio or television, (ii) printed in a commercial newspaper or
16a commercial magazine, or (iii) displayed on a billboard or

1electronic message board at any time.
2    (b) The proper name or image of any executive branch
3constitutional officer or member of the General Assembly may
4not appear on any (i) bumper stickers, (ii) commercial
5billboards, (iii) lapel pins or buttons, (iv) magnets, (v)
6stickers, and (vi) other similar promotional items, that are
7not in furtherance of the person's official State duties or
8governmental and public service functions, if designed, paid
9for, prepared, or distributed using public dollars. This
10subsection does not apply to stocks of items existing on the
11effective date of this amendatory Act of the 93rd General
12Assembly.
13    (b-5) During a period beginning September 1 of the year of
14a general election and ending the day after the general
15election, the proper name, image, or voice of any executive
16branch constitutional officer or member of the General Assembly
17shall not be included in any public announcement related to the
18award of any contract or grant paid for with State dollars.
19    Nothing in this subsection (b-5) prohibits: (i) a State
20agency from making a public announcement about the issuance of
21a grant or a contract, provided the public announcement does
22not include the proper name, image, or voice of any executive
23branch constitutional officer or member of the General
24Assembly; (ii) a legislative committee or commission from
25meeting and conducting business; or (iii) an executive branch
26constitutional officer or member of the General Assembly from

1attending any public or private event associated with the award
2or grant of contract or from being included on a list of
3attendees disseminated to the public.
4    For purposes of this subsection (b-5), a "public
5announcement" means any written or oral statement disseminated
6to the public, by any medium, that is designed, paid for,
7prepared, or distributed using State dollars.
8    (c) This Section does not apply to communications funded
9through expenditures required to be reported under Article 9 of
10the Election Code.

12    Section 99. Effective date. This Act takes effect upon
