AMENDMENT TO HOUSE BILL 4362

2    AMENDMENT NO. ______. Amend House Bill 4362 on page 1, by
3replacing lines 22 and 23 with the following:
4"in prisons of this State, in a county jail, or on probation or
5other alternative form of punishment when the person convicted
6imprisoned received a pardon from the governor stating that";
7and
 
8on page 2, line 2, by changing "imprisoned" to "convicted
9imprisoned"; and
 
10on page 2, line 11, by changing "include an additional" to
11"award"; and
 
12on page 2, line 13, by changing "after imprisonment" to "as the
13result of a wrongful conviction"; and
 
14on page 6, by replacing lines 7 and 8 with the following:

1"been convicted or has been incarcerated as a pretrial detainee
2served a term of imprisonment and has received a certificate of
3innocence"; and
 
4on page 7, by replacing lines 4 and 5 with the following:
5"crimes in Illinois and subsequently imprisoned have been
6frustrated in seeking"; and
 
7on page 7, line 22, by changing "imprisoned" to "sentenced
8imprisoned"; and
 
9on page 8, by replacing lines 5 and 6 with the following:
10"innocence of an unjust conviction or pretrial incarceration
11and imprisonment, the petitioner must attach to his or her";
12and
 
13on page 8, line 10, by changing "to a term of imprisonment" to
14"to a term of imprisonment"; and
 
15on page 9, line 21, by changing "imprisoned" to "sentenced";
16and
 
17on page 13, by inserting immediately below line 1 the
18following:
19    "(k) Any convicted individual who otherwise meets the
20requirements of this Section shall receive a certificate of

1innocence, regardless of whether his or her sentence included
2physical confinement in a jail or prison.".
