AMENDMENT TO HOUSE BILL 3222

2    AMENDMENT NO. ______. Amend House Bill 3222 on page 1, by
3replacing lines 21 and 22 with the following:
 
4    "Section 15. The Director of the Department of Natural
5Resources, on behalf of the State of Illinois, is authorized
6and directed to terminate all contractual interests of the
7State of Illinois provided in the Agreement between the State
8of Illinois, through the former Department of Conservation, and
9the City of Pana, a Municipal Corporation, situated in
10Christian County, made on June 28, 1949, for the purpose of
11funding the construction of a dam and water reservoir to create
12the Pana Lake Project.
 
13    Section 20. The State of Illinois contractual interests
14authorized and directed to be terminated by this Act include
15the following:
16    (1) Rights to develop, manage, and maintain any and all of

1the lands associated with the Pana Lake Project, as described
2in Exhibit A of the Agreement, as part of a Statewide lake,
3water storage, and public recreation system, including public
4hunting and fishing grounds development of game management and
5reforestation and to use said area for the preservation and
6propagation of fish and wildlife thereon for 99 years.
7    (2) Obligation of the City of Pana to maintain the Pana
8Lake Project at its own sole cost and expense and keep in good
9repair at all times the dam and all facilities erected in
10connection therewith.
11    (3) Right to purchase the land occupied by the Pana Lake
12Project if the City of Pana shall at any time determine to sell
13such land and the improvements thereon.
 
14    Section 25. The State of Illinois paid $100,000 toward the
15Pana Lake Project in consideration for obtaining the foregoing
16contractual interests pursuant to appropriation of State funds
17for the purpose made in Section 4 of Senate Bill 662 by the
1865th General Assembly, approved July 21, 1947.
 
19    Section 30. The State of Illinois shall not receive
20consideration for the termination of its contractual rights of
21the June 28, 1949 Agreement.
 
22    Section 35. The Director of the Department of Natural
23Resources shall execute a mutual termination with the City of

1Pana terminating both parties' interests in the June 28, 1949
2Agreement.
 
3    Section 99. Effective date. This Act takes effect upon
4becoming law.".
