Amend House Bill 5243 as follows: | 3 | | by replacing line 17, on page 67, through line 6, on page 68, | 4 | | with the following: | 5 | | " Notwithstanding any other provision of law, in all | 6 | | competitive procurements conducted by the Agency after the | 7 | | effective date of this amendatory Act of the 103rd General | 8 | | Assembly for procurement of utility-scale energy storage | 9 | | resources, the Agency, in ranking the bids for evaluation | 10 | | and selection, shall apply a downward bid price adjustment | 11 | | equal to the bid adjustment described in Section 5.4.3 of | 12 | | the Agency's 2024 Long-Term Renewable Resources | 13 | | Procurement Plan, as approved by the Illinois Commerce | 14 | | Commission, to any bid submitted by an owner or owners of | 15 | | existing or retired fossil-fueled power plants for any | 16 | | project that is located or proposed to be located at a site | 17 | | connecting to existing utility infrastructure at a |

| 1 | | switchyard that is located within the property boundaries | 2 | | or within a 2-mile radius of the property boundaries of a | 3 | | fossil fuel power plant in this State that was retired | 4 | | subsequent to December 31, 2015, or that is an electric | 5 | | generating unit or large greenhouse gas-emitting unit that | 6 | | is subject to subsection (i) of Section 9.15 of the | 7 | | Environmental Protection Act, and that (i) is located or | 8 | | proposed to be located in or within 2 miles of an equity | 9 | | investment eligible community, as defined by the Illinois | 10 | | Power Agency pursuant to this Act; (ii) is "; and | 11 | | by replacing line 12, on page 176, through line 6, on page 177, | 12 | | with the following: | 13 | | " (b) Within 90 days after the effective date of this | 14 | | amendatory Act of the 103rd General Assembly, the Agency shall | 15 | | develop an energy storage procurement plan in accordance with | 16 | | this Section and Section 16-111.5 of the Public Utilities Act. | 17 | | The energy storage procurement plan shall further require | 18 | | that, in order to qualify, the owner of the energy storage | 19 | | resources must have entered, or commit to enter, into a | 20 | | project labor agreement for the construction of the energy | 21 | | storage resource and certify that not less than the prevailing | 22 | | wage, as determined by the Prevailing Wage Act, was or will be | 23 | | paid to employees who are engaged in construction activities | 24 | | associated with the energy storage resource. Additionally, if | 25 | | the owner or owners of the energy storage resources own |

| 1 | | existing or retired fossil fuel power plants, the owner or | 2 | | owners shall commit to (1) coordinate with the Department of | 3 | | Commerce and Economic Opportunity to develop and provide an | 4 | | additional job training and education program to existing and | 5 | | former employees of fossil fuel power plants who are or were | 6 | | members of a labor union to provide the requisite skills, | 7 | | knowledge, and training required to operate and maintain | 8 | | energy storage resources; and (2) create employment | 9 | | opportunities for persons who graduate from that job training | 10 | | and education program. In the alternative to (1) and (2), for | 11 | | existing employees of a fossil-fueled power plant in Illinois | 12 | | who are members of a labor union, the owner shall commit to | 13 | | providing opportunities for such employees to seek job | 14 | | training or education opportunities at the expense of the | 15 | | employer for up to a stated amount, employer-paid outplacement | 16 | | services, and opportunities to apply for other positions with | 17 | | the employer, and for the development and operation of energy | 18 | | storage resources at the former or to be retired fossil fuel | 19 | | power plant site, the owner shall use, to the extent possible, | 20 | | labor union, State of Illinois, or other job and workforce | 21 | | training programs established to support the development, | 22 | | construction, and operation of renewable energy and energy | 23 | | storage resources in Illinois. | 24 | | Within 120 days after the Commission's approval of the | 25 | | owner's energy storage contract, the owner shall submit to the | 26 | | Commission a diversity, equity, and inclusion plan consistent |
