AMENDMENT TO HOUSE BILL 5355

AMENDMENT NO. ______. Amend House Bill 5355 by replacing line 4 on page 1 through line 6 on page 8 with the following:

"Section 5. The Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois is amended by adding Section 2310-730 as follows:

(20 ILCS 2310/2310-730 new)

Sec. 2310-730. Nonopioid alternatives pamphlet. The Department of Public Health shall develop and publish on its website an educational pamphlet regarding the use of nonopioid alternatives for the treatment of acute nonoperative, acute perioperative, subacute, or chronic pain. The pamphlet shall, at a minimum, conform with the most current CDC Clinical Practice Guideline for Prescribing Opioids for Pain published by the Centers for Disease Control and Prevention and shall include:

(1) information on available nonopioid alternatives for the treatment of pain, including available nonopioid medicinal drugs or drug products and nonpharmacological therapies; and

(2) the advantages and disadvantages of the use of nonopioid alternatives."; and

on page 8, line 7, by replacing "100" with "10"; and

on page 9, by replacing lines 21 through 24 with "drug formulary. This subsection does not preclude opioid drugs from being preferred over other opioid drugs or nonopioid drugs from being preferred over other nonopioid drugs."; and

on page 9, line 25, by replacing "105" with "15"; and

by replacing lines 16 on page 10 through line 12 on page 11 with the following: "shall ensure that nonopioid drugs preferred on the Departments preferred drug list, and approved by the U.S. Food and Drug Administration, for the treatment or management of pain shall not be disadvantaged or discouraged with respect to coverage relative to any opioid or narcotic drug for the treatment or management of pain.

Section 99. Effective date. Sections 10 and 15 of this Act take effect January 1, 2026.".
