1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by
5changing Sections 3-101, 3-111, and 3-111.1 as follows:
 
6    (625 ILCS 5/3-101)  (from Ch. 95 1/2, par. 3-101)
7    Sec. 3-101. Certificate of title required.
8    (a) Except as provided in Section 3-102, every owner of a
9vehicle which is in this State and for which no Illinois
10certificate of title has been issued by the Secretary of State
11shall make application to the Secretary of State for an
12Illinois a certificate of title of the vehicle. Except as
13provided in Section 3-102, every owner of a vehicle, excluding
14vehicles acquired by insurance companies through a settlement
15of an insurance claim or by lienholders taking title through
16repossession, that is in this State for which no Illinois
17certificate of title has been issued by the Secretary of State
18and every owner of a vehicle that is in the State applying for
19a duplicate certificate of title or a corrected certificate of
20title, including a dealer lien release certificate of title,
21must make application to the Secretary of State for an
22Illinois duplicate certificate of title or corrected
23certificate of title. A certificate of title issued to any

1owner of a vehicle, excluding vehicles acquired by insurance
2companies through a settlement of an insurance claim or by
3lienholders taking title through repossession, in this State
4showing an Illinois address for the owner that has been issued
5by an entity other than the Secretary of State must be
6converted to an Illinois title before the owner can transfer
7ownership of the vehicle.
8    Under no circumstances shall a dealer required to obtain
9an Illinois certificate of title pursuant to this Code be
10allowed to obtain an out-of-state certificate of title for
11purposes of a vehicle held for sale in this State by the
12dealer. Under no circumstances shall a dealer be allowed to
13obtain an out-of-state certificate of title in lieu of an
14Illinois-issued dealer lien release certificate of title when
15a dealer may have need of such title issuance. Nothing in this
16Section shall be construed so as to allow a dealer to acquire
17an out-of-state certificate of title in lieu of acquiring an
18Illinois certificate of title for purposes of a vehicle held
19for sale in this State by the dealer.
20    (b) Every owner of a motorcycle or motor driven cycle
21purchased new on and after January 1, 1980 shall make
22application to the Secretary of State for a certificate of
23title. However, if such cycle is not properly manufactured or
24equipped for general highway use pursuant to the provisions of
25this Act, it shall not be eligible for license registration,
26but shall be issued a distinctive certificate of title except

1as provided in Sections 3-102 and 3-110 of this Act.
2    (c) The Secretary of State shall not register or renew the
3registration of a vehicle unless a certificate of title has
4been issued by the Secretary of State to the owner or an
5application therefor has been delivered by the owner to the
6Secretary of State.
7    (d) Every owner of an all-terrain vehicle or off-highway
8motorcycle purchased on or after January 1, 1998 shall make
9application to the Secretary of State for a certificate of
10title.
11    (e) Every owner of a low-speed vehicle manufactured after
12January 1, 2010 shall make application to the Secretary of
13State for a certificate of title.

16    Sec. 3-111. Lost, stolen or mutilated certificates. (a) If
17a certificate of title is lost, stolen, mutilated or destroyed
18or becomes illegible, the first lienholder or, if none, the
19owner or legal representative of the owner named in the
20certificate, as shown by the records of the Secretary of
21State, shall promptly make application to the Secretary of
22State for and may obtain a duplicate upon furnishing
23information satisfactory to the Secretary of State. The
24duplicate certificate of title shall contain the legend "This
25is a duplicate certificate and may be subject to the rights of

1a person under the original certificate." It shall be mailed
2to the first lienholder named in it or, if none, to the owner
3or the owner's designee. A certificate of title or a duplicate
4certificate of title issued by another State showing an
5Illinois address for the owner cannot be used to transfer
6ownership of a vehicle, except if the transfer is to or from an
7insurance company or a lienholder of the vehicle through
8repossession.
9    (b) The Secretary of State shall not issue a duplicate
10certificate of title to any person within 15 days after the
11issuance of an original certificate of title to such person.
12    (c) A person recovering an original certificate of title
13for which a duplicate has been issued shall promptly surrender
14the original certificate to the Secretary of State.
15    (d) An application for a duplicate certificate of title
16must state the current vehicle odometer reading at the time of
17application and that the stated odometer reading is one of the
18following: actual mileage, not the actual mileage or mileage
19is in excess of its mechanical limits.
20    (e) If a Display certificate of title is lost, stolen,
21mutilated or destroyed or becomes illegible, the owner or
22legal representative of the owner named in the original
23Display certificate of title and in the certificate of title,
24as shown by the records of the Secretary of State, shall
25promptly make application for and may obtain a duplicate upon
26furnishing information satisfactory to the Secretary of State.

1The duplicate Display certificate of title shall contain the
2legend "Duplicate Display Certificate of Title." It shall be
3mailed to the owner or legal representative of the owner named
4in the original Display certificate of title and in the
5certificate of title. Such duplicate Display certificate of
6title shall be attached and displayed in the same manner and in
7the same place as the original Display certificate of title
8would have been attached and displayed had it not been lost,
9stolen, mutilated or destroyed or had it not become illegible.

12    Sec. 3-111.1. Corrected certificates. An application for a
13corrected certificate of title must state the current vehicle
14odometer reading at the time of application and that the
15stated odometer reading is one of the following: actual
16mileage, not the actual mileage or mileage is in excess of its
17mechanical limits. The corrected certificate issued under this
18Section shall contain the notation "corrected". A certificate
19of title or a corrected certificate of title issued by another
20State showing an Illinois address for the owner cannot be used
21to transfer ownership of a vehicle, except if the transfer is
22to or from an insurance company or a lienholder of the vehicle
23through repossession. The owner of a vehicle with a
24certificate of title or duplicate certificate of title issued
25by another state showing an Illinois address cannot transfer

1ownership of the vehicle without first converting the
2certificate of title to an Illinois certificate of title,
3except if the transfer is to or from an insurance company or a
4lienholder of the vehicle through repossession.

6    Section 99. Effective date. This Act takes effect upon
7becoming law.
