          Amends the Street Light District Act.  Allows the  owners
      of  record  of  any  area  of  land consisting of one or more
      tracts lying within the boundaries  of  any  street  lighting
      district  to  disconnect  the  land from the district if that
      land (1) is subdivided into residential lots and blocks;  (2)
      is  located  in a subdivision other than the subdivision that
      the district primarily serves; (3) does not receive  services
      from the district; and (4) if disconnected it will not result
      in  the isolation of any part of the street lighting district
      from the remainder of the district.

 1        AN ACT to amend the Street Light District Act by changing
 2    Section 2b.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.   The Street Light District Act is amended by
 6    changing Section 2b as follows:
 7        (70 ILCS 3305/2b) (from Ch. 121, par. 356b)
 8        Sec. 2b. The owner or owners of record  of  any  area  of
 9    land  that  consists  consisting  of one or more tracts lying
10    within the boundaries of any street lighting district and (A)
11    that which (1) is not contiguous in whole or in part  to  any
12    other  street  lighting  district;  (2)  contains  20 or more
13    acres; (3)  is  not  subdivided  into  residential  lots  and
14    blocks;  (4)  is located on the border of the street lighting
15    district; and (5) which, if disconnected, will not result  in
16    the  isolation  of  any  part of the street lighting district
17    from the remainder of the street  lighting  district  or  (B)
18    that  (1) is subdivided into residential lots and blocks; (2)
19    is located in a subdivision other than the  subdivision  that
20    the  district primarily serves; (3) does not receive services
21    from the district; and (4) if disconnected, will  not  result
22    in  the isolation of any part of the street lighting district
23    from the  remainder  of  the  district,  may  have  the  area
24    disconnected as follows:
25        The  owner  or  owners of record of any such area of land
26    shall file a petition in the  circuit  court  of  the  county
27    where  the  land is situated alleging facts in support of the
28    disconnection.  The  street  lighting  district  from   which
29    disconnection  is  sought shall be made a defendant and it or
30    any taxpayer residing in that street lighting  district,  may
31    appear  and  defend  against the petition. If the court finds

 1    that the allegations of the petition are true  and  that  the
 2    area of land is entitled to disconnection, it shall order the
 3    specified   land  disconnected  from  the  designated  street
 4    lighting district.
 5        The area of land or any part thereof disconnected from  a
 6    street lighting district under the provisions of this section
 7    shall  not  be annexed or added to a street lighting district
 8    or included in any petition seeking annexation or addition to
 9    any street lighting district, for a period of  2  years  from
10    the date of such disconnection.
11        The  disconnection  of  any  such  area of land shall not
12    exempt it  from  taxation  for  the  purpose  of  paying  any
13    indebtedness  contracted  by the corporate authorities of the
14    street lighting district prior to the filing of the  petition
15    for  disconnection. On the contrary, the territory designated
16    shall be assessed and taxed to pay  such  indebtedness  until
17    this  indebtedness  is completely paid the same as though the
18    territory had not been disconnected.
