1 AMENDMENT TO HOUSE BILL 729
2 AMENDMENT NO. . Amend House Bill 729 on page 1,
3 lines 2 and 6, by replacing "and 9-21" each time it appears
4 with "9-17, and 9-21 and by adding Section 9-28"; and
5 on page 14, by inserting below line 9 the following:
6 "(10 ILCS 5/9-17) (from Ch. 46, par. 9-17)
7 Sec. 9-17. All statements and reports filed under this
8 Article with the board or county clerk shall be available for
9 examination and copying by the public at all reasonable
10 times. Such person examining a statement or report must first
11 fill out a form prepared by the Board identifying the
12 examiner by name, occupation, address and telephone number,
13 and listing the date of examination and reason for such
14 examination. The board shall supply such forms to the county
15 clerks annually and replenish such forms upon request.
16 The Board or county clerk, as the case may be, shall
17 promptly notify each political committee required to file a
18 statement or report under this Article of each instance of an
19 examination of its statement or report by sending it a
20 duplicate original of the identification form filled out by
21 the person examining its report.
22 Any person who alters or falsifies information on a copy

1 of a statement or report obtained from the State Board of
2 Elections or the county clerk pursuant to Article 9 of this
3 Code and publishes, circulates or distributes such altered or
4 falsified information with the intent to misrepresent
5 contributions received or expenditures made by a candidate or
6 political committee shall be guilty of a Class B misdemeanor.
7 Any person who shall sell or utilize information copied
8 from statements and reports filed with the State Board of
9 Elections or the county clerk pursuant to Article 9 of this
10 Code for the purpose of soliciting contributions or for the
11 purpose of business solicitation shall be guilty of a Class B
12 misdemeanor.

14 on page 16, by inserting below line 5 the following:
15 "(10 ILCS 5/9-28 new)
16 Sec. 9-28. Electronic filing and availability. The
17 Board may by rule provide for the optional electronic filing
18 of expenditure and contribution reports. The Board shall
19 promptly make all reports filed under this Article by all
20 political committees publicly available by means of a
21 searchable database that is accessible through the World Wide
22 Web."; and
23 on page 16, by replacing lines 6 and 7 with the following:
24 "Section 99. Effective date. This Act takes effect on
25 January 1, 1998, except that this Section, the provisions
26 changing Sec. 9-17 of the Election Code, and the provisions
27 adding Sec. 9-28 to the Election Code take effect upon
28 becoming law.".
