1 AMENDMENT TO HOUSE BILL 2152
2 AMENDMENT NO. . Amend House Bill 2152 on page 1, by
3 replacing line 27 with the following:
4 "prescribed by this Code. The court may not authorize
5 attachment of property or any other provisional remedy under
6 this paragraph unless it has obtained jurisdiction over the
7 entity holding title to the property by proper service on
8 that entity. With respect to assets which are real property,
9 no order entered as described in this paragraph shall affect
10 the rights of bona fide purchasers, mortgagees, judgment
11 creditors, or other lien holders who acquire their interests
12 in the property prior to the time a notice of lis pendens
13 pursuant to this Code or a copy of the order is placed of
14 record in the office of the recorder of deeds for the county
15 in which the real property is located."; and
16 on page 6, by inserting below line 1, the following:
17 "With respect to assets which are real property, no order
18 entered under this paragraph shall affect the rights of bona
19 fide purchasers, mortgagees, judgment creditors, or other
20 lien holders who acquire their interests in the property
21 prior to the time a notice of lis pendens pursuant to the
22 Code of Civil Procedure or a copy of the order is placed of
23 record in the office of the recorder of deeds for the county

1 in which the real property is located."; and
2 on page 9, immediately below line 24, by inserting the
3 following:
4 "With respect to assets which are real property, no order
5 entered under this subdivision (2.5) shall affect the rights
6 of bona fide purchasers, mortgagees, judgment creditors, or
7 other lien holders who acquire their interests in the
8 property prior to the time a notice of lis pendens pursuant
9 to the Code of Civil Procedure or a copy of the order is
10 placed of record in the office of the recorder of deeds for
11 the county in which the real property is located.".
