1 AN ACT to amend the Communicable Disease Prevention Act
2 by changing Section 2.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Communicable Disease Prevention Act is
6 amended by changing Section 2 as follows:
7 (410 ILCS 315/2) (from Ch. 111 1/2, par. 22.12)
8 Sec. 2. Immunizations. The Department of Public Health
9 shall promulgate rules and regulations requiring immunization
10 of children against preventable communicable diseases
11 designated by the Director. Before any regulation or
12 amendment of a regulation thereto is prescribed, the
13 Department shall conduct a public hearing regarding the such
14 regulation. The Department may prescribe additional rules and
15 regulations for immunization of other diseases as vaccines
16 are developed.
17 The provisions of this Act shall not apply if:
18 1. The parent or guardian of the child objects to
19 immunization of the child thereto on the grounds that the
20 administration of immunizing agents conflicts with his or
21 her religious tenets or practices or,
22 2. A physician employed by the parent or guardian
23 to provide care and treatment to the child states that
24 the physical condition of the child is such that the
25 administration of one or more of the required immunizing
26 agents would be detrimental to the health of the child.
