1 AMENDMENT TO HOUSE BILL 3461
2 AMENDMENT NO. . Amend House Bill 3461 on page 2, by
3 replacing lines 18 through 30 with the following:
4 "(70 ILCS 200/57-20 new)
5 Sec. 57-20. Board members' appointment.
6 (a) Within 60 days after the effective date of this
7 amendatory Act of 1998, initial appointments to the Board
8 shall be made as follows: 2 members shall be appointed by
9 the Chairman of the Cook County Board of Commissioners, one
10 member shall be appointed by the President of the Will County
11 Board, and 3 members shall be appointed by the Mayor of the
12 Village of Tinley Park. If, in the future, the Board
13 acquires a facility site and desires to construct its own
14 facility in an incorporated area other than in Tinley Park,
15 then, in that event, the size of the Board shall be initially
16 increased to add one additional member who will be appointed
17 by the chief executive of the municipality within which the
18 site lies. The chief executive of that municipality shall
19 appoint a second additional member 24 months after the
20 facility has been opened and in operation. The Tinley Park
21 appointees shall continue to serve and be appointed to the
22 Board. The appointing official may remove any member of the
23 Board appointed by the official in case of incompetency,

1 neglect of duty, or malfeasance in office after service on
2 the member by registered United States mail, return receipt
3 requested, of a copy of the written charges against the
4 member and an opportunity to be publicly heard in person or
5 by counsel in the member's own defense upon not less than 10
6 days' notice.
7 (b) At the first meeting of the initially appointed
8 Board members, they shall, by lot, divide themselves into 2
9 groups. The first group of Board members shall have 2-year
10 terms, and the second group of Board members shall have
11 4-year terms. The successor of each Board member shall have
12 a 4-year term.
13 (c) Members of the Board shall hold office until their
14 respective successors have been appointed and are qualified.
15 Any member may resign from office, and the resignation takes
16 effect when the member's successor has been appointed and
17 qualified. In case of failure to qualify within the time
18 required, abandonment of office, death, conviction of a
19 felony, or removal from office, a member's office shall
20 become vacant. The pertinent official shall appoint an
21 individual to fill the vacant position.
22 (d) Officers of the Board shall be elected for 2-year
23 terms by a vote of a majority of the Board."; and
24 on page 3, by deleting lines 1 through 23; and
25 on page 3, by replacing lines 30 through 33 with "govern the
26 proceedings."; and
27 on page 4, by replacing lines 1 through 5 with "All actions".
