Amends the Illinois Vehicle Code to provide that funeral
processions have the right-of-way when the vehicles have both
their headlights lighted and their hazard warning signal
flashers flashing (instead of having only their headlights
lighted).

1 AN ACT to amend the Illinois Vehicle Code by changing
2 Section 11-1420.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Vehicle Code is amended by
6 changing Section 11-1420 as follows:
7 (625 ILCS 5/11-1420) (from Ch. 95 1/2, par. 11-1420)
8 Sec. 11-1420. Funeral processions.
9 (a) Funeral processions have the right-of-way at
10 intersections when vehicles comprising such procession have
11 their headlights lighted, subject to the following
12 conditions and exceptions:
13 1. Operators of vehicles in a funeral procession shall
14 yield the right-of-way upon the approach of an authorized
15 emergency vehicle giving an audible or visible signal;
16 2. Operators of vehicles in a funeral procession shall
17 yield the right-of-way when directed to do so by a traffic
18 officer;
19 3. The operator of the leading vehicle in a funeral
20 procession shall comply with stop signs and traffic control
21 signals but when the leading vehicle has proceeded across an
22 intersection in accordance with such signal or after stopping
23 as required by the stop sign, all vehicles in such procession
24 may proceed without stopping, regardless of the sign or
25 signal and the leading vehicle and the vehicles in procession
26 shall proceed with due caution.
27 (b) The operator of a vehicle not in the funeral
28 procession shall not drive his vehicle in the funeral
29 procession except when authorized to do so by a traffic
30 officer or when such vehicle is an authorized emergency
31 vehicle giving audible or visible signal.

1 (c) Operators of vehicles not a part of a funeral
2 procession may not form a procession or convoy and have their
3 headlights lighted for the purpose of securing the
4 right-of-way granted by this Section to funeral processions.
5 (d) The operator of a vehicle not in a funeral
6 procession may overtake and pass the vehicles in such
7 procession if such overtaking and passing can be accomplished
8 without causing a traffic hazard or interfering with such
9 procession.
10 (e) The lead vehicle in the funeral procession may be
11 equipped with a flashing amber light which may be used only
12 when such vehicle is used as a lead vehicle in such
13 procession. Vehicles comprising a funeral procession may
14 utilize funeral pennants or flags or windshield stickers or
15 flashing hazard warning signal flashers to identify the
16 individual vehicles in such a procession.
