1 AN ACT to amend the Illinois Public Aid Code by adding
2 Section 12-4.34 and repealing Section 12-4.32.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Public Aid Code is amended by
6 adding Section 12-4.34 as follows:
7 (305 ILCS 5/12-4.34 new)
8 Sec. 12-4.34. Naturalization and nutrition services to
9 noncitizens.
10 (a) Subject to specific appropriation for this purpose,
11 the Department of Human Services is authorized to provide
12 naturalization services to legal immigrants.
13 (b) Subject to specific appropriation for this purpose,
14 the Department of Human Services is authorized to provide
15 nutrition services to noncitizens who are 65 years of age or
16 older, under 18 years of age, or disabled, and who were in
17 the United States prior to August 22, 1996 and are not
18 eligible for the federal food stamp program due to their
19 noncitizen status. The payment levels and other eligibility
20 conditions for these services shall be determined by rule.
21 The Illinois Department is authorized to lower the
22 payment levels established under this subsection or take such
23 other actions during the fiscal year as are necessary to
24 ensure that payments under this subsection do not exceed the
25 amounts appropriated for this purpose. These changes may be
26 accomplished by emergency rule under Section 5-45 of the
27 Illinois Administrative Procedure Act, except that the
28 limitation on the number of emergency rules that may be
29 adopted in a 24-month period shall not apply.
30 (c) This Section is repealed on August 31, 1998.

2 Section 10. The Illinois Public Aid Code is amended by
3 repealing Section 12-4.32.
4 Section 99. Effective date. This Act takes effect upon
5 becoming law.
