1 AMENDMENT TO SENATE BILL 857
2 AMENDMENT NO. . Amend Senate Bill 857 on page 50, in
3 lines 14 and 15, by replacing "shall be a non-voting member"
4 with "shall also be a voting non-voting member"; and
5 on page 50, in line 16, by replacing "Three" with "Two
6 Three"; and
7 on page 50, in line 19, by replacing "education," with
8 "education,"; and
9 on page 50, by replacing line 20 with "education, and one
10 representing diploma education; one"; and
11 on page 134, immediately below line 29, by inserting the
12 following:
13 "Section 70. The Professional Geologist Licensing Act is
14 amended by changing Sections 25, 52, and 65 as follows:

16 Sec. 25. Restrictions and limitations. No person shall,
17 without a valid license issued by the Department (i) in any
18 manner hold himself or herself out to the public as a
19 licensed professional geologist; (ii) attach the title
20 "Licensed Professional Geologist" to his or her name; or

1 (iii) render or offer to render to individuals, corporations,
2 or public agencies services constituting the practice of
3 professional geology.
4 Individuals practicing geology in Illinois as of the
5 effective date of this amendatory Act of 1997 may continue to
6 practice as provided in this Act until the Department has
7 adopted rules implementing this Act. To continue practicing
8 geology after the adoption of rules, individuals shall apply
9 for licensure within 180 days after the effective date of the
10 rules. If an application is received during the 180-day
11 period, the individual may continue to practice until the
12 Department acts to grant or deny licensure. If an
13 application is not filed within the 180-day period, the
14 individual must cease the practice of geology at the
15 conclusion of the 180-day period and until the Department
16 acts to grant a license to the individual.

19 Sec. 52. Alternate qualification for licensure. The
20 Department may issue a license to practice professional
21 geology in Illinois to any applicant who, on or before July
22 1, 1998 within one calendar year after the effective date of
23 this Act, meets the following qualifications:
24 (1) The applicant has completed an application form
25 and remitted the application fee.
26 (2) The applicant meets all of the requirements for
27 a license under subsection (a) of Section 50 excluding
28 the requirements for passing the required examination.

31 Sec. 65. Expiration and renewal of license. The
32 expiration date and renewal period for each license shall be

1 set by rule. A professional geologist whose license has
2 expired may reinstate his or her license at any time within 5
3 years after the expiration thereof, by making a renewal
4 application and by paying the required fee. However, any
5 professional geologist whose license expired while he or she
6 was (i) on active duty with the Armed Forces of the United
7 States or called into service or training by the State
8 militia or (ii) in training or education under the
9 supervision of the United States preliminary to induction
10 into the military service, may have his professional
11 geologist license renewed, reinstated, or restored without
12 paying any lapsed renewal fees if within 2 years after
13 termination of the service, training, or education the
14 professional geologist furnishes the Department with
15 satisfactory evidence of service, training, or education and
16 it has been terminated under honorable conditions.
17 Any professional geologist whose license has expired for
18 more than 5 years may have it restored by making application
19 to the Department, paying the required fee, and filing
20 acceptable proof of fitness to have the license restored. The
21 proof may include sworn evidence certifying active practice
22 in another jurisdiction. If the geologist has not practiced
23 for 5 years or more, the Board shall determine by an
24 evaluation program established by rule, whether that
25 individual is fit to resume active status and may require the
26 professional geologist to complete a period of evaluated
27 professional clinical experience and may require successful
28 completion of an examination.
29 The Department may refuse to issue or may suspend the
30 license of any person who fails to file a return, or to pay
31 the tax, penalty or interest shown in a filed return, or to
32 pay any final assessment of tax, penalty, or interest, as
33 required by any tax Act administered by the Illinois
34 Department of Revenue, until such time as the requirements of

1 any such tax Act are satisfied.
