1 AMENDMENT TO SENATE BILL 1838
2 AMENDMENT NO. . Amend Senate Bill 1838 as follows:
3 by replacing the title with the following:
4 "AN ACT to amend the Community Services Act by adding
5 Section 4.3."; and
6 by replacing everything after the enacting clause with the
7 following:
8 "Section 5. The Community Services Act is amended by
9 adding Section 4.3 as follows:
10 (405 ILCS 30/4.3 new)
11 Sec. 4.3. Family Support Services Voucher Pilot Program.
12 (a) In this Section:
13 "Family member" means a family member as defined by rules
14 adopted by the Department of Human Services.
15 "Family support services" means the services and
16 activities described in subsection (d).
17 (b) The Department of Human Services shall establish a
18 Family Support Services Voucher Pilot Program which shall be
19 a conversion of the program defined in Section 4. The
20 Department may establish no more than 5 pilot programs.
21 (c) The purpose of the pilot program is to do the

1 following:
2 (1) Increase the number of families who are able to
3 access family support services.
4 (2) Provide families with greater control over
5 family support services.
6 (3) Ensure that the diverse family support services
7 needs of families can be accommodated.
8 (4) Encourage a family's contribution toward
9 payment for the family support services they receive.
10 (5) Serve as a pilot program to evaluate the merits
11 of a family support services voucher program in
12 comparison to the traditional respite program.
13 (d) The Department shall contract with community
14 agencies to issue vouchers to participating families, or to
15 employ a voucher-like method that similarly makes services
16 available based on the choice of families. A family may use
17 the vouchers to purchase the following services and
18 activities or to otherwise provide for those services and
19 activities:
20 (1) Services of an in-home caregiver to supervise
21 the family member with a developmental disability in the
22 home or in the community or both when other family
23 members are not present.
24 (2) Services of a person to accompany the family
25 member with a developmental disability on outings,
26 community activities, and similar activities.
27 (3) Registration of the family member with a
28 developmental disability in park district programs,
29 extracurricular school activities, community college
30 classes, and other similar types of community-based
31 programs.
32 (4) Services of home health care personnel if
33 medical training or expertise is required to meet the
34 needs of the family member with a developmental

1 disability.
2 (e) Families may employ the following types of
3 individuals to provide family support services:
4 (1) Related family members who do not reside in the
5 same home as the family member with a developmental
6 disability.
7 (2) Friends or neighbors whom the family designates
8 as capable of meeting the needs of the family member with
9 a developmental disability.
10 (3) Individuals recruited from the community (for
11 example, church members or college students).
12 (4) Individuals who work with the family member
13 with a developmental disability in a different capacity
14 (for example, classroom aide or day program staff).
15 (5) Persons whose services are contracted for
16 through a home health agency licensed under the Home
17 Health Agency Licensing Act.
18 (f) Family support services moneys under the pilot
19 program may not be used to purchase or provide for any of the
20 following services or activities:
21 (1) Out-of-home medical services.
22 (2) Medical, therapeutic, or developmental
23 evaluations.
24 (3) Any product or item (for example, sports
25 equipment, therapeutic devices, or clothing).
26 (4) Family support services provided by a family
27 member whose primary residence is the same as that of the
28 family member with a developmental disability.
29 (5) Services of a person to accompany the family on
30 an overnight trip.
31 (6) Any service or activity that should be provided
32 by the school in which the family member with a
33 developmental disability is enrolled or that occurs as
34 part of that school's typical school routine.

1 (7) Child care services while the primary caretaker
2 works.
3 (g) The Department of Human Services shall submit a
4 report to the General Assembly by March 1, 2000 evaluating
5 the merits of the pilot program.
6 Section 99. Effective date. This Act takes effect
7 January 1, 1999.".
