1 AN ACT concerning hunting and fishing licenses and
2 permits, amending named Acts.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Wildlife Code is amended by changing
6 Section 3.36 as follows:
7 (520 ILCS 5/3.36) (from Ch. 61, par. 3.36)
8 Sec. 3.36. Revocation and suspension.
9 (a) Whenever a license or permit is issued to any person
10 under this Act, and the holder thereof is found guilty of any
11 misrepresentation in obtaining such license or permit or of a
12 violation of any of the provisions of this Act, including
13 administrative rules, his license or permit may be revoked by
14 the Department, and the Department may refuse to issue any
15 permit or license to such person and may suspend the person
16 from engaging in the activity requiring the permit or license
17 for a period of time not to exceed 5 years following such
18 revocation.
19 Department revocation procedures shall be established by
20 Administrative rule.
21 (b) Whenever any person who has not been issued a
22 license or a permit under the provisions of this Code is
23 found guilty of a violation of the provisions of this Code,
24 including administrative rules, the Department may refuse to
25 issue any permit or license to that person, and suspend that
26 person from engaging in the activity requiring the permit or
27 license for a period of time not to exceed 5 years.
28 (c) Any person who knowingly or intentionally violates
29 any of the provisions of this Act, including administrative
30 rules, during such period when his license or permit is
31 revoked or denied by virtue of this Section or during the

1 time he is suspended under subsection (b), shall be guilty of
2 a Class A misdemeanor.
3 (d) Licenses and permits authorized to be issued under
4 the provisions of this Act shall be prepared by the
5 Department and be in such form as prescribed by the
6 Department. The information required on each license shall be
7 completed thereon by the issuing agent or his sub-agent at
8 the time of issuance and each license shall be signed by the
9 licensee, or initialed by the designated purchaser and then
10 signed immediately upon receipt by the licensee, and
11 countersigned by the issuing agent or his sub-agent at the
12 time of issuance. All such licenses shall be supplied by the
13 Department, subject to such rules and regulations as the
14 Department may prescribe. Any license not properly prepared,
15 obtained and signed as required by this Act shall be void.
16 (e) A person whose license or permit to engage in any
17 activity regulated by this Code has been suspended or revoked
18 may not, during the period of the suspension or revocation or
19 until obtaining such a license or permit, (i) be in the
20 company of any person engaging in the activity covered by the
21 suspension or revocation or (ii) serve as a guide, outfitter,
22 or facilitator for a person who is engaged or prepared to
23 engage in the activity covered by the suspension or
24 revocation.
25 (f) No person may be issued or obtain a license or
26 permit or engage in any activity regulated by this Code
27 during the time that the person's privilege to engage in the
28 same or similar activities is suspended or revoked by another
29 state, by a federal agency, or by a province of Canada.

31 Section 10. The Fish and Aquatic Life Code is amended by
32 changing Section 20-105 as follows:

2 Sec. 20-105. License Revocation and suspension; refusal
3 to issue.
4 (a) Whenever a license or permit is issued to any person
5 under this Code and its holder is found guilty of any
6 misrepresentation in obtaining the license or permit or of a
7 violation of any of the provisions of this Code, including
8 administrative rules, the license or permit may be revoked by
9 the Department and the Department may refuse to issue any
10 permit or license to that person and may suspend the person
11 from engaging in the activity requiring the permit or license
12 for a period of time not to exceed 5 years following the
13 revocation. Department revocation procedure shall be
14 established by administrative rule.
15 (b) Whenever any person who has not been issued a
16 license or a permit under the provisions of this Code is
17 found guilty of a violation of the provisions of this Code,
18 including administrative rules, the Department may refuse to

24 rules, during the 5 years following the revocation of his or
25 her license or permit under subsection (a) or during the time
26 he is suspended under subsection (b), shall be guilty of a
27 Class A misdemeanor as provided in Section 20-35.
28 (d) A person whose license or permit to engage in any
29 activity regulated by this Code has been suspended or revoked
30 may not, during the period of the suspension or revocation or
31 until obtaining such a license or permit, (i) be in the
32 company of any person engaging in the activity covered by the
33 suspension or revocation or (ii) serve as a guide, outfitter,
34 or facilitator for a person who is engaged or prepared to

1 engage in the activity covered by the suspension or
2 revocation.
3 (e) No person may be issued or obtain a license or
4 permit or engage in any activity regulated by this Code
5 during the time that the person's privilege to engage in the
6 same or similar activities is suspended or revoked by another
7 state, by a federal agency, or by a province of Canada.

9 Section 99. Effective date. This Act takes effect upon
