1 AMENDMENT TO HOUSE BILL 1194
2 AMENDMENT NO. . Amend House Bill 1194 on page 1, by
3 replacing lines 8 through 30 with the following:
4 "(a) All school officials, including teachers, guidance
5 counselors, and support staff, shall immediately notify the
6 office of the principal in the event that they observe any
7 person in possession of a firearm on school grounds; provided
8 that taking such immediate action to notify the office of the
9 principal would not immediately endanger the health, safety,
10 or welfare of students who are under the direct supervision
11 of the school official or the school official. If the
12 health, safety, or welfare of students under the direct
13 supervision of the school official or of the school official
14 is immediately endangered, the school official shall notify
15 the office of principal as soon as the students under his or
16 her supervision and he or she are no longer under immediate
17 danger. A report is not required by this Section when the
18 school official knows that the person in possession of the
19 firearm is a law enforcement official engaged in the conduct
20 of his or her official duties. Any school official acting in
21 good faith who makes such a report under this Section shall
22 have immunity from any civil or criminal liability that might
23 otherwise be incurred as a result of making the report. The
24 identity of the school official making such report shall not

1 be disclosed except as expressly and specifically authorized
2 by law. Knowingly and willfully failing to comply with this
3 Section is a petty offense. A second or subsequent offense
4 is a Class C misdemeanor.
5 (b) Upon receiving a report from any school official
6 pursuant to this Section, or from any other person, the
7 principal or his or her designee shall immediately notify a
8 local law enforcement agency. If the person found to be in
9 possession of a firearm on school grounds is a student, the
10 principal or his or her designee shall also immediately
11 notify that student's parent or guardian. Any principal or
12 his or her designee acting in good faith who makes such
13 reports under this Section shall have immunity from any civil
14 or criminal liability that might otherwise be incurred or
15 imposed as a result of making the reports. Knowingly and
16 willfully failing to comply with this Section is a petty
17 offense. A second or subsequent offense is a Class C
18 misdemeanor."; and
19 on page 1, line 31, by deleting "petition or compliant.".
