1 AN ACT to amend the Code of Civil Procedure by changing
2 Section 8-1402.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Code of Civil Procedure is amended by
6 changing Section 8-1402 as follows:
7 (735 ILCS 5/8-1402) (from Ch. 110, par. 8-1402)
8 Sec. 8-1402. Interpreter for deaf; accommodation for
9 disabled person. Whenever any deaf person is a party to any
10 legal proceeding of any nature, or a juror or witness
11 therein, the court in all instances shall appoint a qualified
12 interpreter of the deaf sign-language to interpret the
13 proceedings to and the testimony of such deaf person. In the
14 case of a deaf juror, the interpreter shall be available
15 throughout the actual trial and may accompany and communicate
16 with such juror throughout any period during which the jury
17 is sequestered or engaged in its deliberations.
18 Accommodations shall be made in accordance with the federal
19 Americans with Disabilities Act of 1990 so that a qualified
20 individual with a disability may participate as a party,
21 witness, juror, or spectator in any legal proceeding. The
22 court shall determine and allow a reasonable fee for all such
23 interpreter's services provided under this Section which
24 shall be paid out of general county funds.
