1 AN ACT to amend the Counties Code by changing Section
2 5-25012.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Counties Code is amended by changing
6 Section 5-25012 as follows:

8 Sec. 5-25012. Board of health. Except in those cases
9 where a board of 12 members is provided for as authorized in
10 this Section, each county health department shall be managed
11 by a board of health consisting of 8 members appointed by the
12 president or chairman of the county board, with the approval
13 of the county board, for a 3 year term, except that of the
14 first appointees 2 shall serve for one year, 2 for 2 years, 3
15 for 3 years and the term of the member appointed from the
16 county board, as provided in this Section, shall be one year
17 and shall continue until reappointment or until a successor
18 is appointed. Each board of health which has 8 members, may
19 have one additional member appointed by the president or
20 chairman of the county board, with the approval of the county
21 board. The additional member shall first be appointed within
22 90 days after the effective date of this amendatory Act for a
23 term ending July 1, 2002.
24 The county health department in a county having a
25 population of 200,000 or more may, if the county board, by
26 resolution, so provides, be managed by a board of health
27 consisting of 12 members appointed by the president or
28 chairman of the county board, with the approval of the county
29 board, for a 3 year term, except that of the first appointees
30 3 shall serve for one year, 4 for 2 years, 4 for 3 years and
31 the term of the member appointed from the county board, as

1 provided in this Section, shall be one year and shall
2 continue until reappointment or until a successor is
3 appointed. In counties with a population of 200,000 or more
4 which have a board of health of 8 members, the county board
5 may, by resolution, increase the size of the board of health
6 to 12 members, in which case the 4 members added shall be
7 appointed, as of the next anniversary of the present
8 appointments, 2 for terms of 3 years, one for 2 years and one
9 for one year.
10 The county board in counties with a population of more
11 than 100,000 but less than 3,000,000 inhabitants and
12 contiguous to any county with a metropolitan area with more
13 than 1,000,000 inhabitants, may establish compensation for
14 the board of health, as remuneration for their services as
15 members of the board of health. Monthly compensation shall
16 not exceed $200 except in the case of the president of the
17 board of health whose monthly compensation shall not exceed
18 $400.
19 Each multiple-county health department shall be managed
20 by a board of health consisting of 4 members appointed from
21 each county by the president or chairman of the county board
22 with the approval of the county board for a 3 year term,
23 except that of the first appointees from each county one
24 shall serve for one year, one for 2 years, one for 3 years
25 and the term of the member appointed from the county board of
26 each member county, as hereinafter provided, shall be one
27 year and shall continue until reappointment or until a
28 successor is appointed.
29 The term of office of original appointees shall begin on
30 July 1 following their appointment, and the term of all
31 members shall continue until their successors are appointed.
32 All members shall serve without compensation but may be
33 reimbursed for actual necessary expenses incurred in the
34 performance of their duties. At least 2 members of each

1 county board of health shall be physicians licensed in
2 Illinois to practice medicine in all of its branches and at
3 least one member shall be a dentist licensed in Illinois. In
4 counties with a population under 500,000, one member shall be
5 chosen from the county board or the board of county
6 commissioners as the case may be. In counties with a
7 population over 500,000, two members shall be chosen from the
8 county board or the board of county commissioners as the case
9 may be. At least one member from each county on each
10 multiple-county board of health shall be a physician licensed
11 in Illinois to practice medicine in all of its branches, one
12 member from each county on each multiple-county board of
13 health shall be chosen from the county board or the board of
14 county commissioners, as the case may be, and at least one
15 member of the board of health shall be a dentist licensed in
16 Illinois. Whenever possible, at least one member shall have
17 experience in the field of mental health. All members shall
18 be chosen for their special fitness for membership on the
19 board.
20 Any member may be removed for misconduct or neglect of
21 duty by the chairman or president of the county board, with
22 the approval of the county board, of the county which
23 appointed him.
24 Vacancies shall be filled as in the case of appointment
25 for a full term.
26 Notwithstanding any other provision of this Act to the
27 contrary, a county with a population of 240,000 or more
28 inhabitants that does not currently have a county health
29 department may, by resolution of the county board, establish
30 a board of health consisting of the members of such board.
31 Such board of health shall be advised by a committee which
32 shall consist of at least 5 members appointed by the
33 president or chairman of the county board with the approval
34 of the county board for terms of 3 years; except that of the

1 first appointees at least 2 shall serve for 3 years, at least
2 2 shall serve for 2 years and at least one shall serve for
3 one year. At least one member of the advisory committee
4 shall be a physician licensed in Illinois to practice
5 medicine in all its branches, at least one shall be a dentist
6 licensed in Illinois, and one shall be a nurse licensed in
7 Illinois. All members shall be chosen for their special
8 fitness for membership on the advisory committee.

10 Section 99. Effective date. This Act takes effect upon
11 becoming law.
