1 AMENDMENT TO HOUSE BILL 2574
2 AMENDMENT NO. . Amend House Bill 2574 as follows:
3 on page 1, lines 2 and 8, after "312," each time it appears,
4 by inserting "313,"; and
5 on page 2, line 1, by changing "a written" to "an oral"; and
6 on line 2, by replacing "72 hours" with "7 days 72 hours";
7 and
8 on line 12, by replacing "72-hour" with "7-day 72-hour"; and
9 on page 9, after line 7, by inserting the following:
10 "(720 ILCS 570/313) (from Ch. 56 1/2, par. 1313)
11 Sec. 313. (a) Controlled substances which are lawfully
12 administered in hospitals or institutions licensed under the
13 "Hospital Licensing Act" shall be exempt from the
14 requirements of Sections 308 and 312 and 316 except that the
15 prescription for the controlled substance shall be in writing
16 on the patient's record, signed by the prescriber, dated, and
17 shall state the name, and quantity of controlled substances
18 ordered and the quantity actually administered. The records
19 of such prescriptions shall be maintained for two years and
20 shall be available for inspection by officers and employees
21 of the Department of State Police, and the Department of

1 Professional Regulation.
2 (b) Controlled substances that can lawfully be
3 administered or dispensed directly to a patient in a
4 long-term care facility licensed by the Department of Public
5 Health as a skilled nursing facility, intermediate care
6 facility, or long-term care facility for residents under 22
7 years of age, are exempt from the requirements of Sections
8 308 and 312 and 316. , except that a prescription for a
9 Schedule II controlled substance must be either a written
10 prescription signed by the prescriber or a written
11 prescription transmitted by the prescriber or prescriber's
12 agent to the dispensing pharmacy by facsimile. The facsimile
13 serves as the original written prescription and must be
14 maintained for 2 years from the date of issue in the same
15 manner as a written prescription signed by the prescriber.
16 (c) (Blank). A prescription that is written for a
17 Schedule II controlled substance to be compounded for direct
18 administration by parenteral, intravenous, intramuscular,
19 subcutaneous, or intraspinal infusion to a patient in a
20 private residence, long-term care facility, or hospice
21 setting may be transmitted by facsimile by the prescriber or
22 the prescriber's agent to the pharmacy providing the home
23 infusion services.
24 (d) Controlled substances which are lawfully
25 administered and/or dispensed in drug abuse treatment
26 programs licensed by the Department shall be exempt from the
27 requirements of Sections 308 and 312 and 316, except that the
28 prescription for such controlled substances shall be issued
29 and authenticated on official prescription logs prepared and
30 supplied by the Department. The official prescription logs
31 issued by the Department shall be printed in triplicate on
32 distinctively marked paper and furnished to programs at
33 reasonable cost. The official prescription logs furnished to
34 the programs shall contain, in preprinted form, such

1 information as the Department may require. The official
2 prescription logs shall be properly endorsed by a physician
3 licensed to practice medicine in all its branches issuing the
4 order, with his own signature and the date of ordering, and
5 further endorsed by the practitioner actually administering
6 or dispensing the dosage at the time of such administering or
7 dispensing in accordance with requirements issued by the
8 Department. The duplicate copy shall be retained by the
9 program for a period of not less than three years nor more
10 than seven years; the original and triplicate copy shall be
11 returned to the Department at its principal office in
12 accordance with requirements set forth by the Department.

14 on line 9, by replacing "Controlled" with "Schedule II
15 controlled"; and
16 on lines 11, 14, 19, 21, 22, and 31, before "controlled" each
17 time it appears, by inserting "Schedule II"; and
18 by deleting line 24; and
19 on line 25, by changing "(G)" to "(F)"; and
20 on line 27, by changing "(H)" to "(G)"; and
21 on page 10, after line 7, by inserting the following:
22 "Schedule II controlled substances are exempt from the
23 requirements of this Section to the extent provided in
24 Section 313."; and
25 by deleting line 27; and
26 on line 28, by changing "(G)" to "(F)"; and
27 on line 30, by changing "(H)" to "(G)"; and
28 on page 11, line 2, by changing "shall" to "must" and by
29 inserting "electronic" before "access"; and

1 on page 14, line 17, before "controlled", by inserting
2 "Schedule II"; and
3 on line 18, after the period, by inserting the following:
4 "The advisory committee shall consist of prescribers and
5 dispensers."; and
6 on page 17, after line 9, by inserting the following:
7 "Section 99. Effective date. This Act takes effect
8 April 1, 2000.".
