1 AN ACT to amend the Abandoned Housing Rehabilitation Act.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Abandoned Housing Rehabilitation Act is
5 amended by changing Sections 2 and 3 as follows:
6 (310 ILCS 50/2) (from Ch. 67 1/2, par. 852)
7 Sec. 2. Definitions. As used in this Act:
8 (a) "Property" means any residential real estate for
9 which taxes are delinquent for the preceding 2 years and
10 which has been continuously unoccupied by persons legally in
11 possession for the preceding 1 year.
12 (b) "Nuisance" means any property which because of its
13 physical condition or use is a public nuisance, or any
14 property which constitutes a blight on the surrounding area,
15 or any property which is not fit for human habitation under
16 the applicable fire, building and housing codes. "Nuisance"
17 also means any property on which any illegal activity
18 involving controlled substances (as defined in the Illinois
19 Controlled Substances Act) or cannabis (as defined in the
20 Cannabis Control Act) takes place or any property on which
21 any streetgang-related activity (as defined in the Illinois
22 Streetgang Terrorism Omnibus Prevention Act) takes place.
23 (c) "Organization" means any Illinois corporation,
24 agency, partnership, association, firm or other entity
25 consisting of 2 or more persons organized and conducted on a
26 not-for-profit basis with no personal profit inuring to
27 anyone as a result of its operation which has among its
28 purposes the improvement of housing.
29 (d) "Parties in interest" means any owner or owners of
30 record, judgment creditor, tax purchaser or other party
31 having any legal or equitable title or interest in the

1 property.
2 (e) "Last known address" includes the address where the
3 property is located, or the address as listed in the tax
4 records or as listed pursuant to any owner's registration
5 ordinance duly adopted by a home rule unit of government.
6 (f) "Low or moderate income housing" means housing for
7 persons and families with low or moderate incomes, provided
8 that the income limits for such persons and families shall be
9 the same as those established by rule by the Illinois Housing
10 Development Authority in accordance with subsection (g) of
11 Section 2 of the Illinois Housing Development Act, as
12 amended.
13 (g) "Rehabilitation" means the process of improving the
14 property, including but not limited to bringing property into
15 compliance with applicable fire, housing and building codes.

18 Sec. 3. Petition for temporary possession. An
19 organization may petition for temporary possession of
20 property if:
21 (a) the property has been tax delinquent for the
22 preceding 2 years and has been continuously unoccupied by
23 persons legally in possession for the preceding year;
24 (b) the property is a nuisance;
25 (c) the organization intends to rehabilitate the
26 property and use the property as housing for low and
27 moderate income persons and families; and
28 (d) the organization has sent notice to the parties
29 in interest of the property, by certified or registered
30 mail, mailed to their last known address and posted on
31 the property at least 30 days but not more than 60 days
32 before the date the petition is filed, of the
33 organization's intent to file a petition for possession
