1 AMENDMENT TO SENATE BILL 423
2 AMENDMENT NO. . Amend Senate Bill 423, AS AMENDED,
3 by replacing the title with the following:
4 "AN ACT to amend the Public Utilities Act by adding
5 Section 8-505.1."; and
6 by replacing everything after the enacting clause with the
7 following:
8 "Section 5. The Public Utilities Act is amended by
9 adding Section 8-505.1 as follows:
10 (220 ILCS 5/8-505.1 new)
11 Sec 8-505.1. Non-emergency vegetation management
12 activities.
13 (a) In conducting its non-emergency vegetation
14 management activities in incorporated municipalities a public
15 utility shall:
16 (1) Follow guidelines set forth by the
17 International Society of Arboriculture in effect January
18 1, 1999 and any applicable OSHA or ANSI standards in
19 effect January 1, 1999.
20 (2) Provide no fewer than 21 days notice to the
21 municipality prior to vegetation management activity

1 beginning in the municipality. Maps or a description of
2 the affected area shall be provided to the municipality.
3 Notification shall continue until the municipality
4 requests termination. Requests by the municipality to
5 terminate notifications shall be in writing.
6 (3) Notify affected customers within the
7 municipality no fewer than 7 days before the activity is
8 scheduled to begin.
9 (4) Provide notified customers with a toll-free
10 telephone number to call regarding the vegetation
11 management activities.
12 (b) A public utility shall not be required to comply
13 with the requirements of subsections (a)(2), (a)(3), or
14 (a)(4) when (i) it is taking actions to restore reliable
15 service after interruptions of service; (ii) there is a
16 franchise, contract, or written agreement in effect prior to
17 January 1, 1999 between a public utility and a municipality
18 mandating specific vegetation management practices; or (iii)
19 there is a mutual agreement between a municipality and a
20 public utility to waive the requirements of all or part of
21 subsection (a). The Commission shall have sole authority to
22 investigate and issue complaints against the utility under
23 this Section.".
