1 AMENDMENT TO SENATE BILL 578
2 AMENDMENT NO. . Amend Senate Bill 578, AS AMENDED,
3 by replacing everything after the enacting clause with the
4 following:
5 "Section 5. The Illinois Vehicle Code is amended by
6 changing Section 11-501.4-1 as follows:
7 (625 ILCS 5/11-501.4-1)
8 Sec. 11-501.4-1. Reporting of test results of blood or
9 urine conducted in the regular course of providing emergency
10 medical treatment.
11 (a) Notwithstanding any other provision of law, the
12 results of blood or urine tests performed for the purpose of
13 determining the content of alcohol, other drug or drugs, or
14 intoxicating compound or compounds, or any combination
15 thereof, in an individual's blood or urine conducted upon
16 persons receiving medical treatment in a hospital emergency
17 room for injuries resulting from a motor vehicle accident
18 shall may be disclosed reported to the Department of State
19 Police or local law enforcement agencies of jurisdiction,
20 upon request. Such blood or urine tests are admissible in
21 evidence as a business record exception to the hearsay rule
22 only in prosecutions for any violation of Section 11-501 of

1 this Code or a similar provision of a local ordinance, or in
2 prosecutions for reckless homicide brought under the Criminal
3 Code of 1961.
4 (b) The confidentiality provisions of law pertaining to
5 medical records and medical treatment shall not be applicable
6 with regard to tests performed upon an individual's blood or
7 urine under the provisions of subsection (a) of this Section.
8 No person shall be liable for civil damages or professional
9 discipline as a result of the disclosure or reporting of the
10 tests or the evidentiary use of an individual's blood or
11 urine test results under this Section or Section 11-501.4 or
12 as a result of that person's testimony made available under
13 this Section or Section 11-501.4, except for willful or
14 wanton misconduct.
