1 AN ACT to amend the Illinois Administrative Procedure
2 Act.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Administrative Procedure Act is
6 amended by changing Section 5-70 and by adding Sections 1-32
7 and 1-33 as follows:

9 Sec. 1-32. "Illinois Administrative Code" means the
10 compilation of all currently adopted State agency rules filed
11 with the Secretary of State and maintained on the Illinois
12 Administrative Code Database.
13 (5 ILCS 100/1-33 new)
14 Sec. 1-33. "Illinois Administrative Code Database" means
15 the electronically stored database of State agency rules
16 maintained by the Legislative Information Service and the
17 Joint Committee on Administrative Rules, in cooperation with
18 the Secretary of State.

21 Sec. 5-70. Form and publication of notices.
22 (a) The Secretary of State may prescribe reasonable
23 rules concerning the form of documents to be filed with the
24 Secretary of State and may refuse to accept for filing
25 certified copies that do not comply with the rules. To
26 ensure uniformity throughout the Illinois Administrative Code
27 and between the materials adopted by State agencies and the
28 versions published for use by the public, rule text adopted
29 by filing with the Secretary of State shall be created from

1 the Illinois Administrative Code Database. In addition, the
2 Secretary of State shall publish and maintain the Illinois
3 Register and may prescribe reasonable rules setting forth the
4 manner in which agencies shall submit notices required by
5 this Act for publication in the Illinois Register. The
6 Illinois Register shall be published at least once each week
7 on the same day (unless that day is an official State
8 holiday, in which case the Illinois Register shall be
9 published on the next following business day) and sent to
10 subscribers who subscribe for the publication with the
11 Secretary of State. The Secretary of State may charge a
12 subscription price to subscribers that covers mailing and
13 publication costs.
14 (b) The Secretary of State shall accept for publication
15 in the Illinois Register all Pollution Control Board
16 documents, including but not limited to Board opinions, the
17 results of Board determinations concerning adjusted standards
18 proceedings, notices of petitions for individual adjusted
19 standards, results of Board determinations concerning the
20 necessity for economic impact studies, restricted status
21 lists, hearing notices, and any other documents related to
22 the activities of the Pollution Control Board that the Board
23 deems appropriate for publication.
