Deletes everything after the enacting clause. Amends the Illinois Marriage and Dissolution of Marriage Act. Provides that if a person who is required to pay child support or maintenance is unemployed, the court shall (at present, may), unless the court determines that the person is incapable of being gainfully employed due to a physical or mental condition, order the person to report for participation in a job search, training, or work program at a local Job Training Partnership Act provider. Adds Illinois Employment Training Centers as places to which the court may direct a person for those programs.
Amends the Illinois Public Aid Code, Non-Support Punishment Act, and Illinois Parentage Act of 1984. Provides that whenever it is determined in a court proceeding under one of those Acts that a person who owes a duty of child support or maintenance is unemployed, the court shall (instead of "may") order the person to seek employment, unless the court finds by clear and convincing evidence that the person is incapable of gainful employment due to a physical or mental condition. Adds the Illinois Employment and Training Centers as places and programs to which the court may direct the unemployed person.
