Synopsis As Introduced Amends the Counties Code and the Illinois Municipal Code. Provides that any request for refund of cash contributions paid in lieu of land donations and pursuant to a county or municipal ordinance must be filed with the county or municipality within one year after the date of payment or a longer period, as specified in a county or municipal ordinance or an annexation agreement. Provides that the following information is required in filing the request: (1) the name and address of the person who made the payment; (2) the amount of the cash contribution; (3) the reasons for which a refund is being requested; and (4) evidence that the contribution was made under protest at the time of payment. Provides that the county or municipality may institute procedures to facilitate consideration of refund requests and must require strict compliance with the requirements. Provides that failure to file the request within the deadline imposed and to comply with the requirements constitute grounds for denial of the request. Effective January 1, 2004.
House Committee Amendment No. 2 Provides that requests for the refund of cash contributions paid in lieu of land donations must be filed with the county or the municipality within one year after the date of payment or one year after the date the funds are last used for any unauthorized purpose, whichever is later (rather than one year after the date of payment or a longer period, as specified in a county or municipal ordinance or in an annexation agreement).
