Synopsis As Introduced
Amends the Illinois Highway Code and the Illinois Vehicle Code. Provides that highway commissioners may not permanently close, vacate, or reduce the weight limit on any road or portion thereof without the written approval of the county superintendent of highways and the elected board associated with that road district. Effective immediately.

Replaces everything after the enacting clause. Amends the Illinois Highway Code. Provides that highway commissioners seeking to close, vacate, or permanently reduce the weight limit on any road or portion of a road, not just arterial roads, must get the written approval of the county, rather than the written approval of the county superintendent of highways and the elected board associated with that road district. Provides that the Department of Transportation may file a certificate with a highway commissioner setting forth reasons for the permanent reduction of weight limits on a road under the highway commissioner's jurisdiction. Provides that the highway commissioner shall hold public hearings on any possible permanent weight reduction on a road under his or her jurisdiction. Provides notice requirements for these hearings. Provides that no road shall be permanently posted at a reduced weight limit unless the highway commissioner finds the reduction to be in the public and economic interest, and that no person residing or owning land within 2 miles of the road to be reduced shall have his or her access impeded. Provides that the highway commissioner or county superintendent of highways shall hold proceedings to fix the damages sustained by adjoining land owners. Provides that damage sustained by land owners as a result of the permanent reduction of weight limits on a road may be agreed upon with the individual land owners or released in writing. Provides that any final order for the permanent reduction in weight limit on a road shall be filed with the district clerk. Provides that legal voters living within 2 miles of the affected road may appeal the order to the county superintendent, who shall hold a public hearing to determine whether or not to permanently reduce the weight limit. Provides that the final determination at this hearing may be appealed to a court of law under the Administrative Review Law. Provides that a final determination not to permanently reduce the weight limit on a road shall annul and revoke all proceedings, assessments, releases, and agreements relating to that reduction. Provides that the permanent reduction in weight limits of a road that crosses the boundary of one or more road districts must have the agreement of the highway commissioner of each impacted district. Amends the Illinois Vehicle Code. Provides that a road district is not a local authority for purposes of prohibiting the operation of trucks or other commercial vehicles or imposing permanent weight limitations by ordinance or resolution. Provides that highway commissioners may not permanently post a road or portion of a road at a reduced weight limit except in accordance with the provisions of the Illinois Highway Code. Effective immediately.
