1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by
5changing Section 3-805 as follows:
 
6    (625 ILCS 5/3-805)  (from Ch. 95 1/2, par. 3-805)
7    Sec. 3-805. Electric vehicles.
8    (a) The Until January 1, 2020, the owner of a motor vehicle
9of the first division or a motor vehicle of the second division
10weighing 8,000 pounds or less propelled by an electric engine
11and not utilizing motor fuel, may register such vehicle for a
12fee not to exceed $35 for a 2-year registration period. The
13Secretary may, in his discretion, prescribe that electric
14vehicle registration plates be issued for an indefinite term,
15such term to correspond to the term of registration plates
16issued generally, as provided in Section 3-414.1. In no event
17may the registration fee for electric vehicles exceed $18 per
18registration year. Beginning on January 1, 2020, the
19registration fee for these vehicles shall be equal to the fee
20set forth in Section 3-806 for motor vehicles of the first
21division, other than Autocycles, Motorcycles, Motor Driven
22Cycles, and Pedalcycles. In addition to the registration fees,
23the Secretary shall assess an additional $100 per year in lieu

1of the payment of motor fuel taxes. $1 of the additional fees
2shall be deposited into the Secretary of State Special
3Services Fund and the remainder of the additional fees shall
4be deposited into the Road Fund.
5    (b) Beginning with the 2023 registration year, upon the
6request of the vehicle owner, an electric vehicle owner may
7register an electric vehicle with any qualifying registration
8issued under this Chapter, and an additional $100 surcharge
9shall be collected in addition to the applicable registration
10fee. The $100 additional fee is to identify the vehicle as an
11electric vehicle. The $100 additional fee is an annual, flat
12fee that shall be based on an applicant's new or existing
13registration year for the vehicle's corresponding weight
14category. A designation as an electric vehicle under this
15subsection shall not alter a vehicle's registration. Of the
16additional fees, $1 shall be deposited into the Secretary of
17State Special Services Fund, and the remainder of the
18additional fees shall be deposited into the Road Fund. The
19Secretary shall adopt any rules necessary to implement this
20subsection (b).
