AN ACT concerning transportation.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Highway Code is amended by adding Section 4-105 as follows:

Sec. 4-105. Rubberized asphalt study. The Department shall select a capital improvement project related to roads, parking lots, sidewalks, biking or walking paths, or other pedestrian or vehicular facilities, as a pilot project in which rubberized asphalt shall be used in place of conventional asphalt. The project shall feature at least 2,000 square feet of rubberized asphalt and a similarly sized patch of conventional asphalt, to enable comparisons. The Department shall select the project within 6 months of the effective date of this amendatory Act of the 95th General Assembly, and the project must be completed within 12 months of the effective date of this amendatory Act of the 95th General Assembly. The Department shall report to the General Assembly, no later than 3 months after completion of the project, the results of an initial evaluation of the performance of rubberized asphalt and shall subsequently report its findings once every 3 months.

This Section is repealed 3 years after the effective date of this amendatory Act of the 95th General Assembly.
