SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Microstamping-Enabled Pistols Act. Provides that the Director of the Illinois State Police or the Director's designee shall: (1) within 180 days after the effective date of the Act, engage in and complete an investigation to certify the technological viability of microstamping-enabled pistols. Provides that this investigation shall include live-fire testing evidence; and (2) within 180 days after the effective date of the Act, certify or decline to certify that microstamping-enabled pistols are technologically viable. Establishes procedures that the Illinois State Police must follow after a certification by the Illinois State Police that microstamping-enabled pistols are technologically viable. Provides that it is unlawful for any dealer in firearms licensed under the Firearm Dealer License Certification Act to sell, offer for sale, exchange, give, transfer or deliver any semiautomatic pistol unless such pistol has been verified as a microstamping-enabled pistol. Provides that a dealer who violates this provision is guilty of a Class 3 felony. Provides that the penalty provisions are operative either 4 years after certification that microstamping-enabled pistols are technologically viable by the Director of the Illinois State Police or the Director's designee, or one year after a person association, partnership, corporation, or other entity has been licensed to engage in the business of servicing firearms and their components to ensure compliance with the requirements of the Act, whichever is earlier. 1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Microstamping-Enabled Pistols Act.
 
6    Section 5. Definitions. In this Act:
7    "Microstamp" means a unique alphanumeric or geometric code
8that identifies the make, model, and serial number of a
9firearm.
10    "Microstamping component" means a component part of a
11semiautomatic pistol that will produce a microstamp on at
12least one location of the expended cartridge case each time
13the pistol is fired.
14    "Microstamping-enabled pistol" means a semiautomatic
15pistol that contains a microstamping component.
 
16    Section 10. Microstamping standards and processes.
17    (a) The Director of the Illinois State Police or the
18Director's designee shall:
19        (1) within 180 days after the effective date of this
20    Act, engage in and complete an investigation to certify
21    the technological viability of microstamping-enabled
22    pistols. This investigation shall include live-fire

1    testing evidence; and
2        (2) within 180 days after the effective date of this
3    Act, certify or decline to certify that
4    microstamping-enabled pistols are technologically viable.
5    Following a certification by the Illinois State Police
6    that microstamping-enabled pistols are technologically
7    viable, the Illinois State Police shall:
8            (A) within 365 days after the effective date of
9        this Act, establish performance standards, qualifying
10        criteria and testing protocols applicable to the
11        examination and verification of microstamping-enabled
12        pistols and microstamping components;
13            (B) within 2 years after the effective date of
14        this Act, establish and implement verification
15        processes for microstamping-enabled pistols and
16        microstamping components;
17            (C) within 2 years after the effective date of
18        this Act, establish processes and standards for the
19        training and licensure of persons, associations,
20        partnerships, corporations, or other entities so that
21        they may engage in the business of servicing
22        semiautomatic pistols and their components to ensure
23        compliance with the requirements of this Act; and
24            (D) within 2 years after the effective date of
25        this Act, establish a division within the Illinois
26        State Police to service semiautomatic pistols and

1        their components to ensure compliance with the
2        requirements of this Act.
 
3    Section 15. Microstamping requirements.
4    (a) It is unlawful for any dealer in firearms licensed
5under the Firearm Dealer License Certification Act to sell,
6offer for sale, exchange, give, transfer or deliver any
7semiautomatic pistol unless such pistol has been verified as a
8microstamping-enabled pistol. A pistol may be verified as
9microstamping-enabled if it contains a microstamp component
10installed by its manufacturer or by a State licensed person,
11association, partnership, corporation, or other entity in
12compliance with State standards established by the Director of
13the Illinois State Police or the Director's designee.
14    (b) A violation of subsection (a) is a Class 3 felony.
15    (c) The provisions of this Section do not apply to a pistol
16manufactured prior to the effective date of this Act.
17    (d) This Section becomes operative either 4 years after
18certification that microstamping-enabled pistols are
19technologically viable by the Director of the Illinois State
20Police or the Director's designee, or one year after a person
21association, partnership, corporation, or other entity has
22been licensed to engage in the business of servicing firearms
23and their components to ensure compliance with the
24requirements of this Act, whichever is earlier.
 
25    Section 99. Effective date. This Act takes effect upon
