SYNOPSIS AS INTRODUCED:
 
5 ILCS 315/29 new
5 ILCS 430/5-65 new
20 ILCS 415/8b.21 new
115 ILCS 5/22 new

    Amends the Illinois Public Labor Relations Act. Provides that on and after the effective date of this amendatory Act, no person with a record of 2 or more felony or Class A misdemeanor convictions, or any combination thereof, shall be eligible for hire or appointment. Provides that Class A misdemeanor convictions do not include misdemeanor convictions under the Wildlife Code or the Illinois Vehicle Code, except convictions for violations of Section 11-501 of the Illinois Vehicle Code. Makes corresponding changes in the State Officials and Employees Ethics Act, the Personnel Code, and the Illinois Educational Labor Relations Act. Effective immediately.

1    AN ACT concerning government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Public Labor Relations Act is
5amended by adding Section 29 as follows:
 
6    (5 ILCS 315/29 new)
7    Sec. 29. Hiring or appointment; 2 or more convictions.
8Notwithstanding any other provision of this Act, on and after
9the effective date of this amendatory Act of the 98th General
10Assembly, no person with a record of 2 or more felony or Class
11A misdemeanor convictions, or any combination thereof, shall be
12eligible for hire or appointment by any public employer
13governed under this Act.
14    As used in this Section:
15        "Class A misdemeanor convictions" do not include
16    violations under the Wildlife Code or the Illinois Vehicle
17    Code, except convictions for violations of Section 11-501
18    of the Illinois Vehicle Code.
19        "Public employer" means the State of Illinois; any
20    political subdivision of the State, excluding units of
21    local government; authorities including departments,
22    divisions, bureaus, boards, commissions, or other agencies
23    of the foregoing entities; and any person acting within the

1    scope of his or her authority, express or implied.
 
2    Section 10. The State Officials and Employees Ethics Act is
3amended by adding Section 5-65 as follows:
 
4    (5 ILCS 430/5-65 new)
5    Sec. 5-65. Hiring or appointment; 2 or more convictions.
6Notwithstanding any other provision of this Act, on and after
7the effective date of this amendatory Act of the 98th General
8Assembly, no person with a record of 2 or more felony or Class
9A misdemeanor convictions, or any combination thereof, shall be
10eligible for hire or appointment by any State agency, State
11employee, Officer, or appointee governed under this Act. As
12used in this Section, Class A misdemeanor convictions do not
13include violations under the Wildlife Code or the Illinois
14Vehicle Code, except convictions for violations of Section
1511-501 of the Illinois Vehicle Code.
 
16    Section 15. The Personnel Code is amended by adding Section
178b.21 as follows:
 
18    (20 ILCS 415/8b.21 new)
19    Sec. 8b.21. Hiring or appointment; 2 or more convictions.
20Notwithstanding any other provision of this Code, on and after
21the effective date of this amendatory Act of the 98th General
22Assembly, no person with a record of 2 or more felony or Class

1A misdemeanor convictions, or any combination thereof, shall be
2eligible for hire or appointment under this Code. As used in
3this Section, Class A misdemeanor convictions do not include
4violations under the Wildlife Code or the Illinois Vehicle
5Code, except convictions for violations of Section 11-501 of
6the Illinois Vehicle Code.
 
7    Section 20. The Illinois Educational Labor Relations Act is
8amended by adding Section 22 as follows:
 
9    (115 ILCS 5/22 new)
10    Sec. 22. Hiring or appointment; 2 or more convictions.
11Notwithstanding any other provision of this Act, on and after
12the effective date of this amendatory Act of the 98th General
13Assembly, no person with a record of 2 or more felony or Class
14A misdemeanor convictions, or any combination thereof, shall be
15eligible for hire or appointment by any educational employer
16governed under this Act. As used in this Section, Class A
17misdemeanor convictions do not include violations under the
18Wildlife Code or the Illinois Vehicle Code, except convictions
19for violations of Section 11-501 of the Illinois Vehicle Code.
 
20    Section 99. Effective date. This Act takes effect upon
21becoming law.
