SYNOPSIS AS INTRODUCED:

105 ILCS 5/2-3.153 new

Amends the School Code. Requires the State Board of Education to adopt rules for the elimination of vegetable oils containing trans fats in foods served in public school cafeterias beginning on July 1, 2016 and for the elimination of all foods containing trans fats from public schools beginning on July 1, 2017. Provides that the State Board of Education shall adopt rules to require schools to provide healthy menu options. Effective immediately.

AN ACT concerning education.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The School Code is amended by adding Section 2-3.153 as follows:

Sec. 2-3.153. Trans fats ban.

(a) For the purposes of this Section, "trans fat" means fat that is considered trans fat by the U.S. Food and Drug Administration. "Trans fat" does not include naturally occurring trans fat. Food shall be deemed to contain trans fat under this Section if the food is labeled as, lists as an ingredient, or contains any kind of partially hydrogenated vegetable oil, including without limitation vegetable shortening or margarine. However, food shall not be deemed to contain trans fat under this Section if the food contains less than 0.5 grams of trans fat per serving.

(b) The State Board of Education shall adopt rules for the elimination of vegetable oils containing trans fats in foods served in public school cafeterias beginning on July 1, 2016 and for the elimination of all foods containing trans fats from public schools beginning on July 1, 2017, which ban shall include without limitation all foods sold as part of the school breakfast and lunch programs under the School Breakfast and Lunch Program Act, foods sold in vending machines on school grounds, and competitive foods sold during school hours.

(c) The State Board of Education shall adopt rules to require schools to provide healthy menu options.

Section 99. Effective date. This Act takes effect upon becoming law.
