SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/2-3.153 new

    Amends the School Code. Requires the State Board of Education to adopt rules for the elimination of vegetable oils containing trans fats in foods served in public school cafeterias beginning on July 1, 2016 and for the elimination of all foods containing trans fats from public schools beginning on July 1, 2017. Provides that the State Board of Education shall adopt rules to require schools to provide healthy menu options. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by adding Section
52-3.153 as follows:
 
6    (105 ILCS 5/2-3.153 new)
7    Sec. 2-3.153. Trans fats ban.
8    (a) For the purposes of this Section, "trans fat" means fat
9that is considered trans fat by the U.S. Food and Drug
10Administration. "Trans fat" does not include naturally
11occurring trans fat. Food shall be deemed to contain trans fat
12under this Section if the food is labeled as, lists as an
13ingredient, or contains any kind of partially hydrogenated
14vegetable oil, including without limitation vegetable
15shortening or margarine. However, food shall not be deemed to
16contain trans fat under this Section if the food contains less
17than 0.5 grams of trans fat per serving.
18    (b) The State Board of Education shall adopt rules for the
19elimination of vegetable oils containing trans fats in foods
20served in public school cafeterias beginning on July 1, 2016
21and for the elimination of all foods containing trans fats from
22public schools beginning on July 1, 2017, which ban shall
23include without limitation all foods sold as part of the school

1breakfast and lunch programs under the School Breakfast and
2Lunch Program Act, foods sold in vending machines on school
3grounds, and competitive foods sold during school hours.
4    (c) The State Board of Education shall adopt rules to
5require schools to provide healthy menu options.
 
6    Section 99. Effective date. This Act takes effect upon
7becoming law.
