AMENDMENT TO HOUSE BILL 137

2    AMENDMENT NO. ______. Amend House Bill 137 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The School Code is amended by adding Sections
510-20.53 and 34-18.45 as follows:
 
6    (105 ILCS 5/10-20.53 new)
7    Sec. 10-20.53. Trans fat ban.
8    (a) For the purposes of this Section:
9    "Individually packaged food item" means a food item in the
10manufacturer's original, sealed package.
11    "Trans fat" means fat that is considered trans fat by the
12U.S. Food and Drug Administration. "Trans fat" does not include
13naturally occurring trans fat. Food shall be deemed to contain
14trans fat under this Section if the food is labeled as, lists
15as an ingredient, or contains any kind of partially
16hydrogenated vegetable oil, including without limitation

1vegetable shortening or margarine. However, food shall not be
2deemed to contain trans fat under this Section if the food
3contains less than 0.5 grams of trans fat per serving.
4    (b) Beginning with the 2011-2012 school year, a school
5board shall prohibit schools from selling or serving any
6individually packaged food item that contains trans fat in a
7vending machine, a la carte, or as part of the school breakfast
8program, the school lunch program, or the summer food service
9program. Each school shall certify compliance with this Section
10in writing to the president of the school board, and this
11certification must be read into the record at the next
12regularly scheduled board meeting after receipt of the
13certification.
14    (c) This Section does not apply to individually packaged
15food items sold or served by students off-campus as part of a
16fundraiser or to fundraisers that take place on campus by
17groups that are not associated with the school.

21    Section 99. Effective date. This Act takes effect upon
22becoming law.".
