 1                     AMENDMENT TO HOUSE BILL 318

 2        AMENDMENT NO.     .  Amend House Bill 318 as follows:
 3    on page 1, by replacing line 7 with the following:
 4        ""Age restricted area" means an enclosed designated  area
 5    in  a  retail  establishment  that is directly visible to the
 6    cashier, separated from the other areas of the establishment,
 7    with a single separate entrance through which no one under 18
 8    years of age is allowed to enter.
 9        "Tobacco  product"  means   a   cigar,   loose   tobacco,
10    cigarette, pack of cigarettes, smokeless"; and

11    on  page  1,  by  replacing  lines  11  through  25  with the
12    following:

13        "Section 10.  Tobacco product displays. It is unlawful to
14    sell, offer for sale, give away, or display tobacco  products
15    for  sale  at  any  location  unless the tobacco products are
16    displayed from behind a sales or service counter or in an age
17    restricted area of a retail establishment or in  an  enclosed
18    display  case  so  that  a  consumer  cannot  access  tobacco
19    products  without the assistance of an employee of the retail
20    establishment authorized to sell tobacco products.
21        At the entrance of  the  age  restricted  area  shall  be
22    posted  a  legible  sign at least 12 inches high by 12 inches

 2             "Age Restricted Area. No One Under  the  Age  of  18
 3        Permitted to Enter."".
