1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The School Code is amended by changing Sections
5 9-11.2, 9-12, 9-18, 26-2, 26-8, and 26-16 and by adding Section
6 14-16 as follows:
 
7     (105 ILCS 5/9-11.2)  (from Ch. 122, par. 9-11.2)
8     Sec. 9-11.2. For all school districts electing candidates
9 to a board of education in a manner other than at large,
10 candidates not elected at large who file nominating petitions
11 for a full term shall be grouped together by area of residence
12 as follows:
13     (1) by congressional townships, or
14     (2) according to incorporated or unincorporated areas. , or
15     (3) by affected school districts, if the form of ballot
16 prescribed by Format 2a or 2b of Section 9-12 is required to be
17 used for the election.
18     For all school districts electing candidates to a board of
19 education in a manner other than at large, candidates not
20 elected at large who file nominating petitions for an unexpired
21 term shall be grouped together by area of residence as follows:
22     (1) by congressional townships, or
23     (2) according to incorporated or unincorporated areas. , or
24     (3) by affected school districts, if the form of ballot
25 prescribed by Format 2a or 2b of Section 9-12 is required to be
26 used for the election.
27     Candidate Except in those instances when the ballot under
28 Format 5 of Section 9-12 is required to be used, candidate
29 groupings by area of residence for unexpired full terms shall
30 precede the candidate groupings by area of residence for full
31 unexpired terms on the ballot. In all instances, however, the
32 ballot order of each candidate grouping shall be determined by

1 the order of petition filing or lottery held pursuant to
2 Section 9-11.1 in the following manner:
3     The area of residence of the candidate determined to be
4 first by order of petition filing or by lottery shall be listed
5 first among the candidate groupings on the ballot. All other
6 candidates from the same area of residence will follow
7 according to order of petition filing or the lottery. The area
8 of residence of the candidate determined to be second by the
9 order of petition filing or the lottery shall be listed second
10 among the candidate groupings on the ballot. All other
11 candidates from the same area of residence will follow
12 according to the order of petition filing or the lottery. The
13 ballot order of additional candidate groupings by area of
14 residence shall be established in a like manner.
15     In any school district that elects its board members
16 according to area of residence and that has one or more
17 unexpired terms to be filled at an election, the winner or
18 winners of the unexpired term or terms shall be determined
19 first and independently of those running for full terms. The
20 winners of the full terms shall then be determined taking into
21 consideration the areas of residence of those elected to fill
22 the unexpired term or terms.
23     "Area of Residence" means congressional township and ,
24 incorporated and unincorporated territories, and, if the form
25 of ballot prescribed by Format 2a or 2b of Section 9-12 is
26 required to be used in electing candidates to a board of
27 education, affected school districts.
28     "Affected school district" means either of the 2 entire
29 elementary school districts that are formed into a combined
30 school district established as provided in subsection (a-5) of
31 Section 11B-7.

28     Ballot position for candidates shall be determined by the

31     This format is used when school board members are elected
32 at large. Membership on the school board is not restricted by
33 area of residence.
34     Types of school districts generally using this format are:

1     Common school districts;
2     Community unit and community consolidated school districts
3 formed on or after January 1, 1975;
4     Community unit school districts formed prior to January 1,
5 1975 that elect board members at large and without restriction
6 by area of residence within the district under subsection (c)
7 of Section 11A-8;
8     Community unit, community consolidated and combined school
9 districts in which more than 90% of the population is in one
10 congressional township;
11     High school districts in which less than 15% of the taxable
12 property is located in unincorporated territory; and unit
13 districts (OLD TYPE);
14     Combined school districts formed on or after July 1, 1983;
15     Combined school districts formed before July 1, 1983 and
16 community consolidated school districts that elect board
17 members at large and without restriction by area of residence
18 within the district under subsection (c) of Section 11B-7.)

20     Ballot position for incorporated and unincorporated areas
21 shall be determined by the order of petition filing or lottery
22 held pursuant to Sections 9-11.1 and 9-11.2.
23     This format is used by community unit, community
24 consolidated and combined school districts when the territory
25 is less than 2 congressional townships, or 72 square miles, but
26 consists of more than one congressional township, or 36 square
27 miles, outside of the corporate limits of any city, village or
28 incorporated town within the school district. The School Code
29 requires that not more than 5 board members shall be selected
30 from any city, village or incorporated town in the school
31 district. At least two board members must reside in the
32 unincorporated area of the school district.
33     Except for those community unit school districts formed
34 before January 1, 1975 that elect board members at large and

2 under subsection (c) of Section 11A-8 and except for combined
3 school districts formed before July 1, 1983 and community
4 consolidated school districts that elect board members at large

6 district under subsection (c) of Section 11B-7, this format
7 applies to community unit and community consolidated school
8 districts formed prior to January 1, 1975 and combined school
9 districts formed prior to July 1, 1983.)

11     Instructions to voter: The board of education shall be
12 composed of members from both the incorporated and the
13 unincorporated area; not more than 5 board members shall be
14 selected from any city, village or incorporated town.

9 format applies to community unit and community consolidated
10 school districts formed prior to January 1, 1975 and combined
11 school districts formed prior to July 1, 1983 when the
12 territory of the school district is greater than 2
13 congressional townships, or 72 square miles. This format
14 applies only when less than 75% of the population is in one
15 congressional township. Congressional townships of less than
16 100 inhabitants shall not be considered for the purpose of such
17 mandatory board representation. In this case, not more than 3
18 board members may be selected from any one congressional
19 township.)

31 members are to be selected is located in a county under
32 township organization and if the surveyed boundaries of a
33 congressional township from which one or more of those school
34 board members is to be selected, as described by township
35 number and range, are coterminous with the boundaries of the

1 township as identified by the township name assigned to it as a
2 political subdivision of the State, then that township may be
3 referred to on the ballot by both its township name and by
4 township number and range.)

31     (a) This Section may be referred to as Brittany's Law. The
32 General Assembly finds the following:
33         (1) Each year, school districts across this State
34     celebrate their students' accomplishments through

1     graduation ceremonies at which high school diplomas are
2     bestowed upon students who have completed their high school
3     requirements.
4         (2) There are children with disabilities in this State
5     who have finished 4 years of high school, but whose
6     individualized education programs prescribe the
7     continuation of special education, transition planning,
8     transition services, or related services beyond the
9     completion of 4 years of high school.
10         (3) It is well-established that the awarding of a high
11     school diploma to and the high school graduation of a child
12     with a disability is tantamount to the termination of
13     eligibility for special education and related services for
14     the student under applicable federal law.
15         (4) Many children with disabilities who will continue
16     their public education in accordance with their
17     individualized education programs after finishing 4 years
18     of high school wish to celebrate their accomplishments by
19     participating in a graduation ceremony with their
20     classmates.
21         (5) The opportunity for classmates with disabilities
22     and those without disabilities to celebrate their
23     accomplishments together only occurs once, and the
24     opportunity to celebrate the receipt of a diploma several
25     years after one's classmates have graduated diminishes the
26     experience for students whose age peers have left high
27     school several years earlier.
28     (b) Beginning March 1, 2005, each school district that
29 operates a high school must have a policy and procedures that
30 allow a child with a disability who will have completed 4 years
31 of high school at the end of a school year to participate in
32 the graduation ceremony of the student's high school graduating
33 class and receive a certificate of completion if the student's
34 individualized education program prescribes special education,
35 transition planning, transition services, or related services
36 beyond the student's 4 years of high school. The policy and

1 procedures must require timely and meaningful written notice to
2 children with disabilities and their parents or guardians about
3 the school district's policy and procedures adopted in
4 accordance with this Section.
5     (c) The State Board of Education shall monitor and enforce
6 compliance with the provisions of this Section and is
7 authorized to adopt rules for that purpose.

10     Sec. 26-2. Enrolled pupils below 7 or over 17 16.
11     (a) Any person having custody or control of a child who is
12 below the age of 7 years or is 17 years of age or above the age
13 of 16 years and who is enrolled in any of grades 1 through 12,
14 in the public school shall cause him to attend the public
15 school in the district wherein he resides when it is in session
16 during the regular school term, unless he is excused under
17 paragraph paragraphs 2, 3, 4, or 5, or 6 of Section 26-1.
18     (b) A school district shall deny reenrollment in its
19 secondary schools to any child above the age of 19 years of age
20 or above who has dropped out of school and who could not,
21 because of age and lack of credits, attend classes during the
22 normal school year and graduate before his or her twenty-first
23 birthday. A district may, however, enroll the child in a
24 graduation incentives program under Section 26-16 of this Code
25 or an alternative learning opportunities program established
26 under Article 13B. No child shall be denied reenrollment for
27 the above reasons unless the school district first offers the
28 child due process as required in cases of expulsion under
29 Section 10-22.6. If a child is denied reenrollment after being
30 provided with due process, the school district must provide
31 counseling to that child and must direct that child to
32 alternative educational programs, including adult education
33 programs, that lead to graduation or receipt of a GED diploma.
34     (c) A school or school district may deny enrollment to a
35 student 17 16 years of age or older for one semester for

1 failure to meet minimum academic standards if all of the
2 following conditions are met:
3         (1) The student achieved a grade point average of less
4     than "D" (or its equivalent) in the semester immediately
5     prior to the current semester.
6         (2) The student and the student's parent or guardian
7     are given written notice warning that the student is
8     failing academically and is subject to denial from
9     enrollment for one semester unless a "D" average (or its
10     equivalent) or better is attained in the current semester.
11         (3) The parent or guardian is provided with the right
12     to appeal the notice, as determined by the State Board of
13     Education in accordance with due process.
14         (4) The student is provided with an academic
15     improvement plan and academic remediation services.
16         (5) The student fails to achieve a "D" average (or its
17     equivalent) or better in the current semester.
18     A school or school district may deny enrollment to a
19 student 17 16 years of age or older for one semester for
20 failure to meet minimum attendance standards if all of the
21 following conditions are met:
22         (1) The student was absent without valid cause for 20%
23     or more of the attendance days in the semester immediately
24     prior to the current semester.
25         (2) The student and the student's parent or guardian

34     remediation services, including without limitation
35     assessment, counseling, and support services.

2     A school or school district may not deny enrollment to a
3 student (or reenrollment to a dropout) who is at least 17 16
4 years of age or older but below not more than 19 years for more
5 than one consecutive semester for failure to meet academic or
6 attendance standards.
7     (d) No child may be denied enrollment or reenrollment under
8 this Section in violation of the Individuals with Disabilities
9 Education Act or the Americans with Disabilities Act.
10     (e) In this subsection (e), "reenrolled student" means a
11 dropout who has reenrolled full-time in a public school. Each
12 school district shall identify, track, and report on the
13 educational progress and outcomes of reenrolled students as a
14 subset of the district's required reporting on all enrollments.
15 A reenrolled student who again drops out must not be counted
16 again against a district's dropout rate performance measure.
17 The State Board of Education shall set performance standards
18 for programs serving reenrolled students.
19     (f) The State Board of Education shall adopt any rules
20 necessary to implement the changes to this Section made by
21 Public Act 93-803 this amendatory Act of the 93rd General
22 Assembly.

3     Sec. 26-8. Determination as to compliance - Complaint in
4 circuit court. A truant officer or, in a school district that
5 does not have a truant officer, the regional superintendent of
6 schools or his or her designee, after giving the notice
7 provided in Section 26-7, shall determine whether the notice
8 has been complied with. If 3 notices have been given and the
9 notices have not been complied with, and if the persons having
10 custody or control have knowingly and wilfully permitted the
11 truant behavior to continue, the regional superintendent of
12 schools, or his or her designee, of the school district where
13 the child resides shall conduct a truancy hearing. If the
14 regional superintendent determines as a result of the hearing
15 that the child is truant, the regional superintendent shall, if
16 age appropriate at the discretion of the regional
17 superintendent, require the student to complete 20 to 40 hours
18 of community service over a period of 90 days. If the truancy
19 persists, the regional superintendent shall (i) make complaint
20 against the persons having custody or control to the state's
21 attorney or in the circuit court in the county where such
22 person resides for failure to comply with the provisions of
23 this Article or (ii) conduct truancy mediation and encourage
24 the student to enroll in a graduation incentives program under
25 Section 26-16 of this Code. If, however, after giving the
26 notice provided in Section 26-7 the truant behavior has
27 continued, and the child is beyond the control of the parents,
28 guardians or custodians, a truancy petition shall be filed
29 under the provisions of Article III of the Juvenile Court Act
30 of 1987.

33     Sec. 26-16. Graduation incentives program.
34     (a) The General Assembly finds that it is critical to

1 provide options for children to succeed in school. The purpose
2 of this Section is to provide incentives for and encourage all
3 Illinois students who have experienced or are experiencing
4 difficulty in the traditional education system to enroll in
5 alternative programs.
6     (b) Any student who is below the age of 20 years no more
7 than 18 years of age is eligible to enroll in a graduation
8 incentives program if he or she:
9         (1) is considered a dropout pursuant to Section 26-2a
10     of this Code;
11         (2) has been suspended or expelled pursuant to Section
12     10-22.6 or 34-19 of this Code;
13         (3) is pregnant or is a parent;
14         (4) has been assessed as chemically dependent; or
15         (5) is enrolled in a bilingual education or LEP
16     program.
17     (c) The following programs qualify as graduation
18 incentives programs for students meeting the criteria
19 established in this Section:
20         (1) Any public elementary or secondary education
21     graduation incentives program established by a school
22     district or by a regional office of education.
23         (2) Any alternative learning opportunities program
24     established pursuant to Article 13B of this Code.
25         (3) Vocational or job training courses approved by the
26     State Superintendent of Education that are available
27     through the Illinois public community college system.
28     Students may apply for reimbursement of 50% of tuition
29     costs for one course per semester or a maximum of 3 courses
30     per school year. Subject to available funds, students may
31     apply for reimbursement of up to 100% of tuition costs upon
32     a showing of employment within 6 months after completion of
33     a vocational or job training program. The qualifications
34     for reimbursement shall be established by the State
35     Superintendent of Education by rule.
36         (4) Job and career programs approved by the State

1     Superintendent of Education that are available through
2     Illinois-accredited private business and vocational
3     schools. Subject to available funds, pupils may apply for
4     reimbursement of up to 100% of tuition costs upon a showing
5     of employment within 6 months after completion of a job or
6     career program. The State Superintendent of Education
7     shall establish, by rule, the qualifications for
8     reimbursement, criteria for determining reimbursement
9     amounts, and limits on reimbursement.
10         (5) Adult education courses that offer preparation for
11     the General Educational Development Test.
12     (d) Graduation incentives programs established by school
13 districts are entitled to claim general State aid, subject to
14 Sections 13B-50, 13B-50.5, and 13B-50.10 of this Code.
15 Graduation incentives programs operated by regional offices of
16 education are entitled to receive general State aid at the
17 foundation level of support per pupil enrolled. A school
18 district must ensure that its graduation incentives program
19 receives supplemental general State aid, transportation
20 reimbursements, and special education resources, if
21 appropriate, for students enrolled in the program.

23     Section 90. The State Mandates Act is amended by adding
24 Section 8.28 as follows:
 
25     (30 ILCS 805/8.28 new)
26     Sec. 8.28. Exempt mandate. Notwithstanding Sections 6 and 8
27 of this Act, no reimbursement by the State is required for the
28 implementation of any mandate created by this amendatory Act of
29 the 93rd General Assembly.
 
30     Section 99. Effective date. This Act takes effect upon
31 becoming law, except that the provisions changing Sections
32 26-2, 26-8, and 26-16 of the School Code take effect January 1,
33 2005.
