 1                    AMENDMENT TO HOUSE BILL 3465

 2        AMENDMENT NO.     .  Amend House Bill 3465,  AS  AMENDED,
 3    by  replacing  everything  after the enacting clause with the
 4    following:

 5        "Section 5.  The Southern Illinois University  Management
 6    Act is amended by changing Sections 2, 4, and 5 as follows:

 7        (110 ILCS 520/2) (from Ch. 144, par. 652)
 8        Sec.  2.  Members of Board; appointment; student members;
 9    selection. The term of each appointed member of the Board who
10    is in office on June 30, 2003 shall terminate at the close of
11    business on that date or when all of the new  members  to  be
12    initially  appointed  under  this  amendatory Act of the 93rd
13    General  Assembly  have  been  appointed  by  the   Governor,
14    whichever  occurs  later.  The  Board  shall  consist  of the
15    following 7 members appointed by the Governor,  by  and  with
16    the  advice and consent of the Senate, for terms beginning on
17    July 1, 2003, or as soon as possible thereafter,  3  of  whom
18    shall   be  graduates  of  Southern  Illinois  University  at
19    Carbondale, Southern Illinois University School  of  Law,  or
20    Southern  Illinois University School of Medicine or reside in
21    Johnson,  Randolph,  Perry,  Franklin,  Williamson,  Jackson,
22    Massac, Hardin,  Pope,  Saline,  Hamilton,  White,  Gallatin,

 1    Alexander,  Pulaski,   or  Union  County,  3 of whom shall be
 2    graduates of Southern Illinois University at Edwardsville  or
 3    Southern  Illinois  School of Dentistry or reside in Madison,
 4    St. Clair,  Bond,  Macoupin,  Clinton,  Fayette,  Montgomery,
 5    Washington,  or  Monroe  County,  and  one of whom shall be a
 6    resident  of  this  State,  the  Superintendent   of   Public
 7    Instruction,  or  his chief assistant for liaison with higher
 8    education when designated to serve in his place,  ex-officio,
 9    and one voting student member designated by the Governor from
10    each  one  campus of the University and one nonvoting student
11    member from the campus of the University not  represented  by
12    the  voting student member.  The Governor shall designate one
13    of the student members serving on the Board to serve  as  the
14    voting  student  member.  Each student member shall be chosen
15    by the respective campuses of Southern Illinois University at
16    Carbondale and Edwardsville.  The method  of  choosing  these
17    student members shall be by campus-wide student election, and
18    any student designated by the Governor to be a voting student
19    member  shall  be  one of the students chosen by this method.
20    The student members shall serve terms of one  year  beginning
21    on  July  1  of  each  year,  except that the student members
22    initially selected shall serve a term beginning on  the  date
23    of  such  selection  and expiring on the next succeeding June
24    30.  To be eligible for selection as a student member and  to
25    be eligible to remain as a voting or nonvoting student member
26    of  the  Board,  a  student member must be a resident of this
27    State, must have and maintain a grade point average  that  is
28    equivalent to at least 2.5 on a 4.0 scale, and must be a full
29    time  student enrolled at all times during his or her term of
30    office except for that part of the  term  which  follows  the
31    completion  of  the last full regular semester of an academic
32    year and precedes the first  full  regular  semester  of  the
33    succeeding   academic   year  at  the  university  (sometimes
34    commonly referred to as the summer session or summer school).

 1    If a voting or nonvoting student member serving on the  Board
 2    fails  to continue to meet or maintain the residency, minimum
 3    grade point average, or enrollment requirement established by
 4    this Section, his or her membership on  the  Board  shall  be
 5    deemed  to have terminated by operation of law.  No more than
 6    4  of  the  members  appointed  by  the  Governor  shall   be
 7    affiliated  with  the  same  political  party.   Each  member
 8    appointed  by  the Governor must be a resident of this State.
 9    A failure to meet  or  maintain  this  residency  requirement
10    constitutes  a  resignation from and creates a vacancy in the
11    Board.  Of the members initially appointed by the Governor on
12    or after July 1, 2003, 2 members shall serve for terms ending
13    June 30, 2005, 2 members shall serve for  terms  ending  June
14    30,  2007,  and  the  remaining members shall serve for terms
15    ending June 30, 2009.  Upon the expiration of  the  terms  of
16    members  initially appointed by the Governor on or after July
17    1, 2003, their respective successors shall be  appointed  for
18    terms  of  6  years  from the third Monday in January of each
19    odd-numbered year and until their respective  successors  are
20    appointed  for  like  terms.  If the Senate is not in session
21    appointments shall be made as in the case of vacancies.

25        Sec.  4.   Members  of  the  Board  shall  serve  without
26    compensation  but shall be entitled to reasonable amounts for
27    expenses necessarily incurred in  the  performance  of  their
28    duties.   Such  expenses  incurred  by any non-voting student
29    member may, at the discretion of the Chairperson Chairman  of
30    the  Board, be provided for by advance payment to the student
31    such  member,  who  shall  account  therefor  to  the   Board
32    immediately after each meeting.
33        No  member  of  the Board shall hold or be employed in or

 1    appointed to any office or place under the authority  of  the
 2    Board,  nor  shall  any  member  of  the Board be directly or
 3    indirectly interested in any contract made by the Board,  nor
 4    shall  he  or  she  be  an  employee  of the State or federal
 5    government.  This  Section  does  not  prohibit  the  student
 6    members  of  the  Board  from maintaining normal and official
 7    status as enrolled students or normal student  employment  at
 8    Southern Illinois University.

11        Sec.  5.   Members  of  the Board shall elect annually by
12    secret ballot from their own number  a  chairperson  chairman
13    who shall preside over meetings of the Board and a secretary.
14        Meetings  of  the  Board shall be held at least once each
15    quarter on a campus of Southern Illinois University.  At  all
16    regular  meetings  of  the  Board,  a  majority of its voting
17    members shall constitute a quorum.  The student members shall
18    have all of the privileges of membership, including the right
19    to make and second motions and to attend executive sessions.,
20    other than the right to vote, except that the student  member
21    designated by the Governor as the voting student member shall
22    have  the  right  to  vote  on all Board matters except those
23    involving faculty tenure, faculty promotion or any  issue  on
24    which  the  student member has a direct conflict of interest.
25    A student member who is not entitled to vote on a measure  at
26    a  meeting of the Board or any of its committees shall not be
27    considered a member for the purpose of determining whether  a
28    quorum  is  present at any meeting of the Board or any of its
29    committees the time that measure is voted upon.  No action of
30    the Board shall be invalidated by reason of any vacancies  on
31    the  Board,  or  by reason of any failure to select a student
32    member.
33        Special meetings of  the  Board  may  be  called  by  the

 1    chairperson  chairman of the Board or by any 3 members of the
 2    Board.
 3        At each regular and special meeting that is open  to  the
 4    public, members of the public and employees of the University
 5    shall be afforded time, subject to reasonable constraints, to
 6    make comments to or ask questions of the Board.

 9        Section 99.  Effective date.  This Act  takes  effect  on
10    July 1, 2003.".
