SYNOPSIS AS INTRODUCED:
 
720 ILCS 5/33-6 new

    Amends the Criminal Code of 1961. Provides that a municipal police department or a county sheriff may not hire a person for employment in the municipal police department or county sheriff's office in any capacity if that person had been a full-time, permanent, or part-time police officer in this State or any other jurisdiction and has been decertified as a police officer by the Illinois Law Enforcement Training Standards Board or has been decertified as a police officer under a similar law of another jurisdiction. Provides that a county sheriff or municipal police chief or other police officer in charge of hiring police officers who violates this provision is guilty of a Class A misdemeanor.

1     AN ACT concerning criminal law.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Criminal Code of 1961 is amended by adding
5 Section 33-6 as follows:
 
6     (720 ILCS 5/33-6 new)
7     Sec. 33-6. Hiring decertified police officer prohibited.
8     (a) In this Section, "part-time police officer",
9 "full-time police officer", and "permanent police officer"
10 have the meanings ascribed to them in Section 2 of the Illinois
11 Police Training Act.
12     (b) A municipal police department or a county sheriff may
13 not hire a person for employment in the municipal police
14 department or county sheriff's office in any capacity if that
15 person had been a full-time, permanent, or part-time police
16 officer in this State or any other jurisdiction and has been
17 decertified as a police officer by the Illinois Law Enforcement
18 Training Standards Board under Section 6.1 of the Illinois
19 Police Training Act or has been decertified as a police officer
20 under a similar law of another jurisdiction.
21     (c) Sentence. A violation of this Section by a county
22 sheriff or municipal police chief or other police officer in
23 charge of hiring police officers is a Class A misdemeanor.
