2 AMENDMENT NO. . Amend Senate Bill 349 by replacing
3 everything after the enacting clause with the following:
4 "Section 5. The Illinois Vehicle Code is amended by
5 changing Sections 15-102, 15-107, and 15-111 as follows:
6 (625 ILCS 5/15-102) (from Ch. 95 1/2, par. 15-102)
7 Sec. 15-102. Width of Vehicles.
8 (a) On Class III and non-designated State and local
9 highways, the total outside width of any vehicle or load
10 thereon shall not exceed 8 feet.
11 (b) Except during those times when, due to insufficient
12 light or unfavorable atmospheric conditions, persons and
13 vehicles on the highway are not clearly discernible at a
14 distance of 1000 feet, the following vehicles may exceed the
15 8 feet limitation during the period from a half hour before
16 sunrise to a half hour after sunset:
17 (1) Loads of hay, straw or other similar farm
18 products provided that the load is not more than 12 feet
19 wide.
20 (2) Implements of husbandry being transported on
21 another vehicle and the transporting vehicle while
22 loaded.

1 The following requirements apply to the
2 transportation on another vehicle of an implement of
3 husbandry wider than 8 feet 6 inches on the National
4 System of Interstate and Defense Highways or other
5 highways in the system of State highways:
6 (A) The driver of a vehicle transporting an
7 implement of husbandry that exceeds 8 feet 6 inches
8 in width shall obey all traffic laws and shall check
9 the roadways prior to making a movement in order to
10 ensure that adequate clearance is available for the
11 movement. It is prima facie evidence that the
12 driver of a vehicle transporting an implement of
13 husbandry has failed to check the roadway prior to
14 making a movement if the vehicle is involved in a
15 collision with a bridge, overpass, fixed structure,
16 or properly placed traffic control device or if the
17 vehicle blocks traffic due to its inability to
18 proceed because of a bridge, overpass, fixed
19 structure, or properly placed traffic control
20 device.
21 (B) Flags shall be displayed so as to wave
22 freely at the extremities of overwidth objects and
23 at the extreme ends of all protrusions, projections,
24 and overhangs. All flags shall be clean, bright red
25 flags with no advertising, wording, emblem, or
26 insignia inscribed upon them and at least 18 inches
27 square.
28 (C) "OVERSIZE LOAD" signs are mandatory on the
29 front and rear of all vehicles with loads over 10
30 feet wide. These signs must have 12-inch high black
31 letters with a 2-inch stroke on a yellow sign that
32 is 7 feet wide by 18 inches high.
33 (D) One civilian escort vehicle is required
34 for a load that exceeds 14 feet 6 inches in width

1 and 2 civilian escort vehicles are required for a
2 load that exceeds 16 feet in width on the National
3 System of Interstate and Defense Highways or other
4 highways in the system of State highways.
5 (E) The requirements for a civilian escort
6 vehicle and driver are as follows:
7 (1) The civilian escort vehicle shall be
8 a passenger car or a second division vehicle
9 not exceeding a gross vehicle weight of 8,000
10 pounds that is designed to afford clear and
11 unobstructed vision to both front and rear.
12 (2) The escort vehicle driver must be
13 properly licensed to operate the vehicle.
14 (3) While in use, the escort vehicle must
15 be equipped with illuminated rotating,
16 oscillating, or flashing amber lights or
17 flashing amber strobe lights mounted on top
18 that are of sufficient intensity to be visible
19 at 500 feet in normal sunlight.
20 (4) "OVERSIZE LOAD" signs are mandatory
21 on all escort vehicles. The sign on an escort
22 vehicle shall have 8-inch high black letters on
23 a yellow sign that is 5 feet wide by 12 inches
24 high.
25 (5) When only one escort vehicle is
26 required and it is operating on a two-lane
27 highway, the escort vehicle shall travel
28 approximately 300 feet ahead of the load. The
29 rotating, oscillating, or flashing lights or
30 flashing amber strobe lights and an "OVERSIZE
31 LOAD" sign shall be displayed on the escort
32 vehicle and shall be visible from the front.
33 When only one escort vehicle is required and it
34 is operating on a multilane divided highway,

1 the escort vehicle shall travel approximately
2 300 feet behind the load and the sign and
3 lights shall be visible from the rear.
4 (6) When 2 escort vehicles are required,
5 one escort shall travel approximately 300 feet
6 ahead of the load and the second escort shall
7 travel approximately 300 feet behind the load.
8 The rotating, oscillating, or flashing lights
9 or flashing amber strobe lights and an
10 "OVERSIZE LOAD" sign shall be displayed on the
11 escort vehicles and shall be visible from the
12 front on the lead escort and from the rear on
13 the trailing escort.
14 (7) When traveling within the corporate
15 limits of a municipality, the escort vehicle
16 shall maintain a reasonable and proper distance
17 from the oversize load, consistent with
18 existing traffic conditions.
19 (8) A separate escort shall be provided
20 for each load hauled.
21 (9) The driver of an escort vehicle shall
22 obey all traffic laws.
23 (10) The escort vehicle must be in safe
24 operational condition.
25 (11) The driver of the escort vehicle
26 must be in radio contact with the driver of the
27 vehicle carrying the oversize load.
28 (F) A transport vehicle while under load of
29 more than 8 feet 6 inches in width must be equipped
30 with an illuminated rotating, oscillating, or
31 flashing amber light or lights or a flashing amber
32 strobe light or lights mounted on the top of the cab
33 that are of sufficient intensity to be visible at
34 500 feet in normal sunlight. If the load on the

1 transport vehicle blocks the visibility of the amber
2 lighting from the rear of the vehicle, the vehicle
3 must also be equipped with an illuminated rotating,
4 oscillating, or flashing amber light or lights or a
5 flashing amber strobe light or lights mounted on the
6 rear of the load that are of sufficient intensity to
7 be visible at 500 feet in normal sunlight.
8 (G) When a flashing amber light is required on
9 the transport vehicle under load and it is operating
10 on a two-lane highway, the transport vehicle shall
11 display to the rear at least one rotating,
12 oscillating, or flashing light or a flashing amber
13 strobe light and an "OVERSIZE LOAD" sign. When a
14 flashing amber light is required on the transport
15 vehicle under load and it is operating on a
16 multilane divided highway, the sign and light shall
17 be visible from the rear.
18 (H) Maximum speed shall be 45 miles per hour
19 on all such moves or 5 miles per hour above the
20 posted minimum speed limit, whichever is greater,
21 but the vehicle shall not at any time exceed the
22 posted maximum speed limit.
23 (3) Portable buildings designed and used for
24 agricultural and livestock raising operations that are
25 not more than 14 feet wide and with not more than a 1
26 foot overhang along the left side of the hauling vehicle.
27 However, the buildings shall not be transported more than
28 10 miles and not on any route that is part of the
29 National System of Interstate and Defense Highways.
30 All buildings when being transported shall display at
31 least 2 red cloth flags, not less than 12 inches square,
32 mounted as high as practicable on the left and right side of
33 the building.
34 A State Police escort shall be required if it is

1 necessary for this load to use part of the left lane when
2 crossing any 2 laned State highway bridge.
3 (c) Vehicles propelled by electric power obtained from
4 overhead trolley wires operated wholly within the corporate
5 limits of a municipality are also exempt from the width
6 limitation.
7 (d) Exemptions are also granted to vehicles designed for
8 the carrying of more than 10 persons under the following
9 conditions:
10 (1) (Blank);
11 (2) When operated within any public transportation
12 service with the approval of local authorities or an
13 appropriate public body authorized by law to provide
14 public transportation. Any vehicle so operated may be 8
15 feet 6 inches in width; or
16 (3) When a county engineer or superintendent of
17 highways, after giving due consideration to the mass
18 transportation needs of the area and to the width and
19 condition of the road, has determined that the operation
20 of buses wider than 8 feet will not pose an undue safety
21 hazard on a particular county or township road segment,
22 he or she may authorize buses not to exceed 8 feet 6
23 inches in width on any highway under that engineer's or
24 superintendent's jurisdiction.
25 (e) A vehicle and load traveling upon the National
26 System of Interstate and Defense Highways or any other
27 highway in the system of State highways that has been
28 designated as a Class I or Class II highway by the
29 Department, or any street or highway designated by local
30 authorities or road district commissioners, may have a total
31 outside width of 8 feet 6 inches, provided that certain
32 safety devices that the Department determines as necessary
33 for the safe and efficient operation of motor vehicles shall
34 not be included in the calculation of width.

1 (e-1) A vehicle and load more than 8 feet wide but not
2 exceeding 8 feet 6 inches in width is allowed access
3 according to the following:
4 (1) A vehicle and load not exceeding 73,280 pounds
5 in weight is allowed access from any State designated
6 highway onto any county, township, or municipal highway
7 for a distance of 5 highway miles for the purpose of
8 loading and unloading, provided:
9 (A) The vehicle and load does not exceed 65
10 feet overall length.
11 (B) There is no sign prohibiting that access.
12 (C) The route is not being used as a
13 thoroughfare between State designated highways.
14 (2) A vehicle and load not exceeding 73,280 pounds
15 in weight is allowed access from any State designated
16 highway onto any county or township highway for a
17 distance of 5 highway miles or onto any municipal highway
18 for a distance of one highway mile for the purpose of
19 food, fuel, repairs, and rest, provided:
20 (A) The vehicle and load does not exceed 65
21 feet overall length.
22 (B) There is no sign prohibiting that access.
23 (C) The route is not being used as a
24 thoroughfare between State designated highways.
25 (3) A vehicle and load not exceeding 80,000 pounds
26 in weight is allowed access from a Class I highway onto
27 any street or highway for a distance of 2one highway
28 milesmile for the purpose of loading, unloading, food,
29 fuel, repairs, and rest, provided there is no sign
30 prohibiting that access.
31 (4) A vehicle and load not exceeding 80,000 pounds
32 in weight is allowed access from a Class I or Class II
33 highway onto any State highway or any locally designated
34 highway for a distance of 5 highway miles for the purpose

1 of loading, unloading, food, fuel, repairs, and rest.
2 (5) A trailer or semi-trailer not exceeding 28 feet
3 6 inches in length, that was originally in combination
4 with a truck tractor, shall have unlimited access to
5 points of loading and unloading.
6 (6) All household goods carriers shall have
7 unlimited access to points of loading and unloading.
8 Section 5-35 of the Illinois Administrative Procedure Act
9 relating to procedures for rulemaking shall not apply to the
10 designation of highways under this paragraph (e).
11 (f) Mirrors required by Section 12-502 of this Code and
12 other safety devices identified by the Department may project
13 up to 14 inches beyond each side of a bus and up to 6 inches
14 beyond each side of any other vehicle, and that projection
15 shall not be deemed a violation of the width restrictions of
16 this Section.
17 (g) Any person who is convicted of violating this
18 Section is subject to the penalty as provided in paragraph
19 (b) of Section 15-113.

22 Sec. 15-107. Length of vehicles.
23 (a) The maximum length of a single vehicle on any
24 highway of this State may not exceed 42 feet except the
25 following:
26 (1) Semitrailers.
27 (2) Charter or regulated route buses may be up to
28 45 feet in length, not including energy absorbing
29 bumpers.
30 (a-1) A motor home as defined in Section 1-145.01 may be
31 up to 45 feet in length, not including energy absorbing
32 bumpers. The length limitations described in this subsection
33 (a-1) shall be exclusive of energy-absorbing bumpers and rear

2 (b) On all non-State highways, the maximum length of
3 vehicles in combinations is as follows:
4 (1) A truck tractor in combination with a
5 semitrailer may not exceed 55 feet overall dimension.
6 (2) A truck tractor-semitrailer-trailer may not
7 exceed 60 feet overall dimension.
8 (3) Combinations specially designed to transport
9 motor vehicles or boats may not exceed 60 feet overall
10 dimension.
11 Vehicles operating during daylight hours when
12 transporting poles, pipes, machinery, or other objects of a
13 structural nature that cannot readily be dismembered are
14 exempt from length limitations, provided that no object may
15 exceed 80 feet in length and the overall dimension of the
16 vehicle including the load may not exceed 100 feet. This
17 exemption does not apply to operation on a Saturday, Sunday,
18 or legal holiday. Legal holidays referred to in this Section
19 are the days on which the following traditional holidays are
20 celebrated: New Year's Day; Memorial Day; Independence Day;
21 Labor Day; Thanksgiving Day; and Christmas Day.
22 Vehicles and loads operated by a public utility while en
23 route to make emergency repairs to public service facilities
24 or properties are exempt from length limitations, provided
25 that during night operations every vehicle and its load must
26 be equipped with a sufficient number of clearance lamps on
27 both sides and marker lamps on the extreme ends of any
28 projecting load to clearly mark the dimensions of the load.
29 A tow truck in combination with a disabled vehicle or
30 combination of disabled vehicles, as provided in paragraph
31 (6) of subsection (c) of this Section, is exempt from length
32 limitations.
33 All other combinations not listed in this subsection (b)
34 may not exceed 60 feet overall dimension.

1 (c) Combinations of vehicles may not exceed a total of 2
2 vehicles except the following:
3 (1) A truck tractor semitrailer may draw one
4 trailer.
5 (2) A truck tractor semitrailer may draw one
6 converter dolly.
7 (3) A truck tractor semitrailer may draw one
8 vehicle that is defined in Chapter 1 as special mobile
9 equipment, provided the overall dimension does not exceed
10 60 feet.
11 (4) A truck in transit may draw 3 trucks in transit
12 coupled together by the triple saddlemount method.
13 (5) Recreational vehicles consisting of 3 vehicles,
14 provided the following:
15 (A) The total overall dimension does not
16 exceed 60 feet.
17 (B) The towing vehicle is a properly
18 registered vehicle capable of towing another vehicle
19 using a fifth-wheel type assembly.
20 (C) The second vehicle in the combination of
21 vehicles is a recreational vehicle that is towed by
22 a fifth-wheel assembly. This vehicle must be
23 properly registered and must be equipped with
24 brakes, regardless of weight.
25 (D) The third vehicle must be the lightest of
26 the 3 vehicles and be a trailer or semitrailer
27 designed or used for transporting a boat,
28 all-terrain vehicle, personal watercraft, or
29 motorcycle.
30 (E) The towed vehicles may be only for the use
31 of the operator of the towing vehicle.
32 (F) All vehicles must be properly equipped
33 with operating brakes and safety equipment required
34 by this Code, except the additional brake

1 requirement in subdivision (C) of this subparagraph
2 (5).
3 (6) A tow truck in combination with a disabled
4 vehicle or combination of disabled vehicles, provided the
5 towing vehicle:
6 (A) Is specifically designed as a tow truck
7 having a gross vehicle weight rating of at least
8 18,000 pounds and equipped with air brakes, provided
9 that air brakes are required only if the towing
10 vehicle is towing a vehicle, semitrailer, or
11 tractor-trailer combination that is equipped with
12 air brakes. For the purpose of this subsection,
13 gross vehicle weight rating, or GVWR, means the
14 value specified by the manufacturer as the loaded
15 weight of the tow truck.
16 (B) Is equipped with flashing, rotating, or
17 oscillating amber lights, visible for at least 500
18 feet in all directions.
19 (C) Is capable of utilizing the lighting and
20 braking systems of the disabled vehicle or
21 combination of vehicles.
22 (D) Does not engage a tow exceeding 50 highway
23 miles from the initial point of wreck or disablement
24 to a place of repair. Any additional movement of the
25 vehicles may occur only upon issuance of
26 authorization for that movement under the provisions
27 of Sections 15-301 through 15-319 of this Code.
28 The Department may by rule or regulation prescribe
29 additional requirements regarding length limitations for a
30 tow truck towing another vehicle.
31 For purposes of this Section, a tow-dolly that merely
32 serves as substitute wheels for another legally licensed
33 vehicle is considered part of the licensed vehicle and not a
34 separate vehicle.

1 (d) On Class I highways there are no overall length
2 limitations on motor vehicles operating in combinations
3 provided:
4 (1) The length of a semitrailer, unladen or with
5 load, in combination with a truck tractor may not exceed
6 53 feet.
7 (2) The distance between the kingpin and the center
8 of the rear axle of a semitrailer longer than 48 feet, in
9 combination with a truck tractor, may not exceed 45 feet
10 6 inches.
11 (3) The length of a semitrailer or trailer, unladen
12 or with load, operated in a truck
13 tractor-semitrailer-trailer combination, may not exceed
14 28 feet 6 inches.
15 (4) Maxi-cube combinations, as defined in Chapter
16 1, may not exceed 65 feet overall dimension.
17 (5) Combinations of vehicles specifically designed
18 to transport motor vehicles or boats may not exceed 65
19 feet overall dimension. The length limitation is
20 inclusive of front and rear bumpers but exclusive of the
21 overhang of the transported vehicles, as provided in
22 paragraph (i) of this Section.
23 (6) Stinger steered semitrailer vehicles as defined
24 in Chapter 1, specifically designed to transport motor
25 vehicles or boats, may not exceed 75 feet overall
26 dimension. The length limitation is inclusive of front
27 and rear bumpers but exclusive of the overhang of the
28 transported vehicles, as provided in paragraph (i) of
29 this Section.
30 (7) A truck in transit transporting 3 trucks
31 coupled together by the triple saddlemount method may not
32 exceed 75 feet overall dimension.
33 Vehicles operating during daylight hours when
34 transporting poles, pipes, machinery, or other objects of a

28 Section 5-35 of the Illinois Administrative Procedure Act
29 relating to procedures for rulemaking shall not apply to the
30 designation of highways under this paragraph (d).
31 (e) On Class II highways there are no overall length
32 limitations on motor vehicles operating in combinations,
33 provided:

18 exceed 65 feet overall dimension. The length limitation
19 is inclusive of front and rear bumpers but exclusive of
20 the overhang of the transported vehicles, as provided in
21 paragraph (i) of this Section.
22 (7) Stinger steered semitrailer vehicles, as
23 defined in Chapter 1, specifically designed to transport
24 motor vehicles or boats, may not exceed 75 feet overall
25 dimension. The length limitation is inclusive of front
26 and rear bumpers but exclusive of the overhang of the
27 transported vehicles, as provided in paragraph (i) of
28 this Section.
29 (8) A truck in transit transporting 3 trucks

26 such as bumpers, refrigeration units or air compressors and
27 other devices, that the Department may interpret as necessary
28 for safe and efficient operation; except that no device
29 excluded under this paragraph shall have by its design or use
30 the capability to carry cargo.
31 (e-1) Combinations of vehicles not exceeding 65 feet
32 overall length are allowed access as follows:
33 (1) From any State designated highway onto any
34 county, township, or municipal highway for a distance of

23 highway for a distance of 2one highway milesmile for
24 the purpose of loading, unloading, food, fuel, repairs,
25 and rest, provided there is no sign prohibiting that
26 access.
27 (2) From a Class I or Class II highway onto any
28 State highway or any locally designated highway for a
29 distance of 5 highway miles for the purpose of loading,
30 unloading, food, fuel, repairs, and rest.
31 (e-3) Combinations of vehicles over 65 feet in length
32 operated by household goods carriers, with no overall length
33 limitations except as provided in subsections (d) and (e) of
34 this Section, have unlimited access to points of loading and

1 unloading.
2 Section 5-35 of the Illinois Administrative Procedure Act
3 relating to procedures for rulemaking shall not apply to the
4 designation of highways under this paragraph (e).
5 (f) On Class III and other non-designated State
6 highways, the length limitations for vehicles in combination
7 are as follows:
8 (1) Truck tractor-semitrailer combinations, must
9 comply with either a maximum 55 feet overall wheel base
10 or a maximum 65 feet extreme overall dimension.
11 (2) Semitrailers, unladen or with load, may not
12 exceed 53 feet overall dimension.
13 (3) No truck tractor-semitrailer-trailer
14 combination may exceed 60 feet extreme overall dimension.
15 (4) The distance between the kingpin and the center
16 axle of a semitrailer longer than 48 feet, in combination
17 with a truck tractor, may not exceed 42 feet 6 inches.
18 (g) Length limitations in the preceding subsections of
19 this Section 15-107 do not apply to the following:
20 (1) Vehicles operated in the daytime, except on
21 Saturdays, Sundays, or legal holidays, when transporting
22 poles, pipe, machinery, or other objects of a structural
23 nature that cannot readily be dismembered, provided the
24 overall length of vehicle and load may not exceed 100
25 feet and no object exceeding 80 feet in length may be
26 transported unless a permit has been obtained as
27 authorized in Section 15-301.
28 (2) Vehicles and loads operated by a public utility
29 while en route to make emergency repairs to public
30 service facilities or properties, but during night
31 operation every vehicle and its load must be equipped
32 with a sufficient number of clearance lamps on both sides
33 and marker lamps upon the extreme ends of any projecting
34 load to clearly mark the dimensions of the load.

1 (3) A tow truck in combination with a disabled
2 vehicle or combination of disabled vehicles, provided the
3 towing vehicle meets the following conditions:
4 (A) It is specifically designed as a tow truck
5 having a gross vehicle weight rating of at least
6 18,000 pounds and equipped with air brakes, provided
7 that air brakes are required only if the towing
8 vehicle is towing a vehicle, semitrailer, or
9 tractor-trailer combination that is equipped with
10 air brakes.
11 (B) It is equipped with flashing, rotating, or
12 oscillating amber lights, visible for at least 500
13 feet in all directions.
14 (C) It is capable of utilizing the lighting
15 and braking systems of the disabled vehicle or
16 combination of vehicles.
17 (D) It does not engage in a tow exceeding 50
18 miles from the initial point of wreck or
19 disablement.
20 The Department may by rule or regulation prescribe
21 additional requirements regarding length limitations for a
22 tow truck towing another vehicle.
23 For the purpose of this subsection, gross vehicle weight
24 rating, or GVWR, shall mean the value specified by the
25 manufacturer as the loaded weight of the tow truck. Legal
26 holidays referred to in this Section shall be specified as
27 the day on which the following traditional holidays are
28 celebrated:
29 New Year's Day;
30 Memorial Day;
31 Independence Day;
32 Labor Day;
33 Thanksgiving Day; and
34 Christmas Day.

1 (h) The load upon any vehicle operated alone, or the
2 load upon the front vehicle of a combination of vehicles,
3 shall not extend more than 3 feet beyond the front wheels of
4 the vehicle or the front bumper of the vehicle if it is
5 equipped with a front bumper. The provisions of this
6 subsection (h) shall not apply to any vehicle or combination
7 of vehicles specifically designed for the collection and
8 transportation of waste, garbage, or recyclable materials
9 during the vehicle's operation in the course of collecting
10 garbage, waste, or recyclable materials if the vehicle is
11 traveling at a speed not in excess of 15 miles per hour
12 during the vehicle's operation and in the course of
13 collecting garbage, waste, or recyclable materials. However,
14 in no instance shall the load extend more than 7 feet beyond
15 the front wheels of the vehicle or the front bumper of the
16 vehicle if it is equipped with a front bumper.
17 (i) The load upon the front vehicle of a combination of
18 vehicles specifically designed to transport motor vehicles
19 shall not extend more than 3 feet beyond the foremost part of
20 the transporting vehicle and the load upon the rear
21 transporting vehicle shall not extend more than 4 feet beyond
22 the rear of the bed or body of the vehicle. This paragraph
23 shall only be applicable upon highways designated in
24 paragraphs (d) and (e) of this Section.
25 (j) Articulated vehicles comprised of 2 sections,
26 neither of which exceeds a length of 42 feet, designed for
27 the carrying of more than 10 persons, may be up to 60 feet in
28 length, not including energy absorbing bumpers, provided that
29 the vehicles are:
30 1. operated by or for any public body or motor
31 carrier authorized by law to provide public
32 transportation services; or
33 2. operated in local public transportation service
34 by any other person and the municipality in which the

1 service is to be provided approved the operation of the
2 vehicle.

5 Section is subject to the penalty as provided in paragraph

11 Sec. 15-111. Wheel and axle loads and gross weights.
12 (a) On non-designated highways, no vehicle or
13 combination of vehicles equipped with pneumatic tires may be
14 operated, unladen or with load, when the total weight
15 transmitted to the road surface exceeds 18,000 pounds on a
16 single axle or 32,000 pounds on a tandem axle with no axle
17 within the tandem exceeding 18,000 pounds except:
18 (1) when a different limit is established and
19 posted in accordance with Section 15-316 of this Code;
20 (2) vehicles for which the Department of
21 Transportation and local authorities issue overweight
22 permits under authority of Section 15-301 of this Code;
23 (3) tow trucks subject to the conditions provided
24 in subsection (d) may not exceed 24,000 pounds on a
25 single rear axle or 44,000 pounds on a tandem rear axle;
26 (4) any single axle of a 2-axle truck weighing
27 36,000 pounds or less and not a part of a combination of
28 vehicles, shall not exceed 20,000 pounds;
29 (5) any single axle of a 2-axle truck equipped with
30 a personnel lift or digger derrick, weighing 36,000
31 pounds or less, owned and operated by a public utility,
32 shall not exceed 20,000 pounds;
33 (6) any single axle of a 2-axle truck specially

1 equipped with a front loading compactor used exclusively
2 for garbage, refuse, or recycling may not exceed 20,000
3 pounds per axle, provided that the gross weight of the
4 vehicle does not exceed 40,000 pounds;
5 (7) a truck, not in combination and specially
6 equipped with a selfcompactor or an industrial roll-off
7 hoist and roll-off container, used exclusively for
8 garbage or refuse operations may, when laden, transmit
9 upon the road surface the following maximum weights:
10 22,000 pounds on a single axle; 40,000 pounds on a tandem
11 axle;
12 (8) a truck, not in combination and used
13 exclusively for the collection of rendering materials,
14 may, when laden, transmit upon the road surface the
15 following maximum weights: 22,000 pounds on a single
16 axle; 40,000 pounds on a tandem axle;
17 (9) tandem axles on a 3-axle truck registered as a
18 Special Hauling Vehicle, manufactured prior to or in the
19 model year of 2004 and first registered in Illinois prior
20 to January 1, 2005, with a distance greater than 72
21 inches but not more than 96 inches between any series of
22 2 axles, is allowed a combined weight on the series not
23 to exceed 36,000 pounds and neither axle of the series
24 may exceed 18,000 pounds. Any vehicle of this type
25 manufactured after the model year of 2004 or first
26 registered in Illinois after December 31, 2004 may not
27 exceed a combined weight of 32,000 pounds through the
28 series of 2 axles and neither axle of the series may
29 exceed 18,000 pounds;
30 (10) tandem axles on a 4-axle truck mixer, whose
31 fourth axle is a road surface engaging mixer trailing
32 axle, registered as a Special Hauling Vehicle, used
33 exclusively for the mixing and transportation of concrete
34 and manufactured prior to or in the model year of 2004

1 and first registered in Illinois prior to January 1,
2 2005, with a distance greater than 72 inches but not more
3 than 96 inches between any series of 2 axles, is allowed
4 a combined weight on the series not to exceed 36,000
5 pounds and neither axle of the series may exceed 18,000
6 pounds. Any vehicle of this type manufactured after the
7 model year of 2004 or first registered in Illinois after
8 December 31, 2004 may not exceed a combined weight of
9 32,000 pounds through the series of 2 axles and neither
10 axle of the series may exceed 18,000 pounds;
11 (11) 4-axle vehicles or a 5 or more axle
12 combination of vehicles: The weight transmitted upon the
13 road surface through any series of 3 axles whose centers
14 are more than 96 inches apart, measured between extreme
15 axles in the series, may not exceed those allowed in the
16 table contained in subsection (f) of this Section. No
17 axle or tandem axle of the series may exceed the maximum
18 weight permitted under this Section for a single or
19 tandem axle.
20 No vehicle or combination of vehicles equipped with other
21 than pneumatic tires may be operated, unladen or with load,
22 upon the highways of this State when the gross weight on the
23 road surface through any wheel exceeds 800 pounds per inch
24 width of tire tread or when the gross weight on the road
25 surface through any axle exceeds 16,000 pounds.
26 (b) On non-designated highways, the gross weight of
27 vehicles and combination of vehicles including the weight of
28 the vehicle or combination and its maximum load shall be
29 subject to the foregoing limitations and further shall not
30 exceed the following gross weights dependent upon the number
31 of axles and distance between extreme axles of the vehicle or
32 combination measured longitudinally to the nearest foot.

31 city, nor shall the gross weight of any 2 axle motor vehicle

1 (d) Weight limitations shall not apply to vehicles
2 (including loads) operated by a public utility when
3 transporting equipment required for emergency repair of
4 public utility facilities or properties or water wells.
5 A combination of vehicles, including a tow truck and a
6 disabled vehicle or disabled combination of vehicles, that
7 exceeds the weight restriction imposed by this Code, may be
8 operated on a public highway in this State provided that
9 neither the disabled vehicle nor any vehicle being towed nor
10 the tow truck itself shall exceed the weight limitations
11 permitted under this Chapter. During the towing operation,
12 neither the tow truck nor the vehicle combination shall
13 exceed 24,000 pounds on a single rear axle and 44,000 pounds
14 on a tandem rear axle, provided the towing vehicle:
15 (1) is specifically designed as a tow truck having
16 a gross vehicle weight rating of at least 18,000 pounds
17 and is equipped with air brakes, provided that air brakes
18 are required only if the towing vehicle is towing a
19 vehicle, semitrailer, or tractor-trailer combination that
20 is equipped with air brakes;
21 (2) is equipped with flashing, rotating, or
22 oscillating amber lights, visible for at least 500 feet
23 in all directions;
24 (3) is capable of utilizing the lighting and
25 braking systems of the disabled vehicle or combination of
26 vehicles; and
27 (4) does not engage in a tow exceeding 20 miles
28 from the initial point of wreck or disablement. Any
29 additional movement of the vehicles may occur only upon
30 issuance of authorization for that movement under the
31 provisions of Sections 15-301 through 15-319 of this
32 Code.
33 Gross weight limits shall not apply to the combination of
34 the tow truck and vehicles being towed. The tow truck

1 license plate must cover the operating empty weight of the
2 tow truck only. The weight of each vehicle being towed shall
3 be covered by a valid license plate issued to the owner or
4 operator of the vehicle being towed and displayed on that
5 vehicle. If no valid plate issued to the owner or operator of
6 that vehicle is displayed on that vehicle, or the plate
7 displayed on that vehicle does not cover the weight of the
8 vehicle, the weight of the vehicle shall be covered by the
9 third tow truck plate issued to the owner or operator of the
10 tow truck and temporarily affixed to the vehicle being towed.
11 The Department may by rule or regulation prescribe
12 additional requirements. However, nothing in this Code shall
13 prohibit a tow truck under instructions of a police officer
14 from legally clearing a disabled vehicle, that may be in
15 violation of weight limitations of this Chapter, from the
16 roadway to the berm or shoulder of the highway. If in the
17 opinion of the police officer that location is unsafe, the
18 officer is authorized to have the disabled vehicle towed to
19 the nearest place of safety.
20 For the purpose of this subsection, gross vehicle weight
21 rating, or GVWR, shall mean the value specified by the
22 manufacturer as the loaded weight of the tow truck.
23 (e) No vehicle or combination of vehicles equipped with
24 pneumatic tires shall be operated, unladen or with load, upon
25 the highways of this State in violation of the provisions of
26 any permit issued under the provisions of Sections 15-301
27 through 15-319 of this Chapter.
28 (f) On designated Class I, II, or III highways and the
29 National System of Interstate and Defense Highways, no
30 vehicle or combination of vehicles with pneumatic tires may
31 be operated, unladen or with load, when the total weight on
32 the road surface exceeds the following: 20,000 pounds on a
33 single axle; 34,000 pounds on a tandem axle with no axle
34 within the tandem exceeding 20,000 pounds; 80,000 pounds

1 gross weight for vehicle combinations of 5 or more axles; or
2 a total weight on a group of 2 or more consecutive axles in
3 excess of that weight produced by the application of the
4 following formula: W = 500 times the sum of (LN divided by
5 N-1) + 12N + 36, where "W" equals overall total weight on any
6 group of 2 or more consecutive axles to the nearest 500
7 pounds, "L" equals the distance measured to the nearest foot
8 between extremes of any group of 2 or more consecutive axles,
9 and "N" equals the number of axles in the group under
10 consideration.

19 Local authorities and road district highway
20 commissioners, with respect to streets and highways under
21 their jurisdiction, without additional fees, may also by
22 ordinance or resolution allow the weight limitations of this
23 subsection, provided the maximum gross weight on any one axle
24 shall not exceed 20,000 pounds and the maximum total weight
25 on any tandem axle shall not exceed 34,000 pounds, on
26 designated highways when appropriate regulatory signs giving
27 notice are erected upon the street or highway or portion of
28 any street or highway affected by the ordinance or
29 resolution.
30 The following are exceptions to the above formula:
31 (1) Two consecutive sets of tandem axles may carry
32 a total weight of 34,000 pounds each if the overall
33 distance between the first and last axles of the
34 consecutive sets of tandem axles is 36 feet or more.

1 (2) Vehicles for which a different limit is
2 established and posted in accordance with Section 15-316
3 of this Code.
4 (3) Vehicles for which the Department of
5 Transportation and local authorities issue overweight
6 permits under authority of Section 15-301 of this Code.
7 These vehicles are not subject to the bridge formula.
8 (4) Tow trucks subject to the conditions provided
9 in subsection (d) may not exceed 24,000 pounds on a
10 single rear axle or 44,000 pounds on a tandem rear axle.
11 (5) A tandem axle on a 3-axle truck registered as a
12 Special Hauling Vehicle, manufactured prior to or in the
13 model year of 2004, and registered in Illinois prior to
14 January 1, 2005, with a distance between 2 axles in a
15 series greater than 72 inches but not more than 96 inches
16 may not exceed a total weight of 36,000 pounds and
17 neither axle of the series may exceed 18,000 pounds.
18 (6) A truck not in combination, equipped with a
19 self compactor or an industrial roll-off hoist and
20 roll-off container, used exclusively for garbage or
21 refuse operations, may, when laden, transmit upon the
22 road surface, except when on part of the National System
23 of Interstate and Defense Highways, the following maximum
24 weights: 22,000 pounds on a single axle; 40,000 pounds on
25 a tandem axle; 36,000 pounds gross weight on a 2-axle
26 vehicle; 54,000 pounds gross weight on a 3-axle vehicle.
27 This vehicle is not subject to the bridge formula.
28 (7) Combinations of vehicles, registered as Special
29 Hauling Vehicles that include a semitrailer manufactured
30 prior to or in the model year of 2004, and registered in
31 Illinois prior to January 1, 2005, having 5 axles with a
32 distance of 42 feet or less between extreme axles, may
33 not exceed the following maximum weights: 18,000 pounds
34 on a single axle; 32,000 pounds on a tandem axle; and

1 72,000 pounds gross weight. This combination of vehicles
2 is not subject to the bridge formula. For all those
3 combinations of vehicles that include a semitrailer
4 manufactured after the effective date of this amendatory
5 Act of the 92nd General Assembly, the overall distance
6 between the first and last axles of the 2 sets of tandems
7 must be 18 feet 6 inches or more. Any combination of
8 vehicles that has had its cargo container replaced in its
9 entirety after December 31, 2004 may not exceed the
10 weights allowed by the bridge formula.
11 No vehicle or combination of vehicles equipped with other
12 than pneumatic tires may be operated, unladen or with load,
13 upon the highways of this State when the gross weight on the
14 road surface through any wheel exceeds 800 pounds per inch
15 width of tire tread or when the gross weight on the road
16 surface through any axle exceeds 16,000 pounds.
17 (f-1) A vehicle and load not exceeding 73,280 pounds is
18 allowed access as follows:
19 (1) From any State designated highway onto any
20 county, township, or municipal highway for a distance of
21 5 highway miles for the purpose of loading and unloading,
22 provided:
23 (A) The vehicle and load does not exceed 8
24 feet 6 inches in width and 65 feet overall length.
25 (B) There is no sign prohibiting that access.
26 (C) The route is not being used as a
27 thoroughfare between State designated highways.
28 (2) From any State designated highway onto any
29 county or township highway for a distance of 5 highway
30 miles, or any municipal highway for a distance of one
31 highway mile for the purpose of food, fuel, repairs, and
32 rest, provided:
33 (A) The vehicle and load does not exceed 8
34 feet 6 inches in width and 65 feet overall length.

1 (B) There is no sign prohibiting that access.
2 (C) The route is not being used as a
3 thoroughfare between State designated highways.
4 (f-2) A vehicle and load greater than 73,280 pounds in
5 weight but not exceeding 80,000 pounds is allowed access as
6 follows:
7 (1) From a Class I highway onto any street or
8 highway for a distance of 2one highway milesmile for
9 the purpose of loading, unloading, food, fuel, repairs,
10 and rest, provided there is no sign prohibiting that
11 access.
12 (2) From a Class I, II, or III highway onto any
13 State highway or any local designated highway for a
14 distance of 5 highway miles for the purpose of loading,
15 unloading, food, fuel, repairs, and rest.
16 Section 5-35 of the Illinois Administrative Procedure Act
17 relating to procedures for rulemaking shall not apply to the
18 designation of highways under this subsection.
19 (g) No person shall operate a vehicle or combination of
20 vehicles over a bridge or other elevated structure
21 constituting part of a highway with a gross weight that is
22 greater than the maximum weight permitted by the Department,
23 when the structure is sign posted as provided in this
24 Section.
25 (h) The Department upon request from any local authority
26 shall, or upon its own initiative may, conduct an
27 investigation of any bridge or other elevated structure
28 constituting a part of a highway, and if it finds that the
29 structure cannot with safety to itself withstand the weight
30 of vehicles otherwise permissible under this Code the
31 Department shall determine and declare the maximum weight of
32 vehicles that the structures can withstand, and shall cause
33 or permit suitable signs stating maximum weight to be erected
34 and maintained before each end of the structure. No person

1 shall operate a vehicle or combination of vehicles over any
2 structure with a gross weight that is greater than the posted
3 maximum weight.
4 (i) Upon the trial of any person charged with a
5 violation of subsections (g) or (h) of this Section, proof of
6 the determination of the maximum allowable weight by the
7 Department and the existence of the signs, constitutes
8 conclusive evidence of the maximum weight that can be
9 maintained with safety to the bridge or structure.

11 Section 99. Effective date. This Act takes effect
