 1                    AMENDMENT TO SENATE BILL 362

 2        AMENDMENT NO.     .  Amend Senate Bill 362,  AS  AMENDED,
 3    with  reference  to  page and line numbers of House Amendment
 4    No. 1, on page 2, line 33, by  replacing  "shall"  with  "may
 5    shall"; and

 6    on page 3, line 1, by replacing "shall" with "may shall"; and

 7    on  page  3,  by  replacing  lines  12  through  14  with the
 8    following:
 9    "of the beneficiary is at least 12 years of  age.  The  State
10    Treasurer  shall  adjust  each  account  at least annually to
11    ensure compliance with this Section.  The  Treasurer  shall";
12    and

13    on  page  6,  line  21,  after  the  period, by inserting the
14    following:
15    "The rules shall provide that the College  Savings  Pool  may
16    not offer a share class with a sales load exceeding 4%."; and

17    on page 10, by deleting line 12; and

18    on  page  10,  line  15,  before  the comma, by inserting the
19    following:
20    "and which program does not offer a share class with a  sales
21    load exceeding 4%".
