AMENDMENT TO SENATE BILL 2173

AMENDMENT NO. ______. Amend Senate Bill 2173, AS AMENDED, with reference to page and line numbers of Senate Amendment No. 1, on page 1, after line 22, by inserting the following:

"(a-5) "Consumer Choice of Benefits HMO plan" means a health maintenance organization subscriber contract that, in whole or in part, does not place limitations of restrictions on deductibles, coinsurance, copayments, or any annual or lifetime maximum benefit amounts, but that provides creditable coverage as defined by Section 20 of the Illinois Health Insurance Portability and Accountability Act."; and

on page 2, after line 4, by inserting the following:

"(e) "Health Maintenance Organization" means any organization formed under the laws of this or another state to provide or arrange for one or more health care plans under a system that causes any part of the risk of health care delivery to be borne by the organization or its providers."; and

on page 4, by replacing lines 3 and 4 with the following:

"plans authorized; minimum requirement.

(a) An insurer may offer one or more Consumer Choice of Benefits Health Insurance plans.

(b) A health maintenance organization may offer one or more Consumer Choice Benefits HMO plans, provided that the plan's deductibles and copayments paid for the receipt of basic health care services do not exceed $5,000 per enrollee or $10,000 per family in a calendar or contract year.".
