SYNOPSIS AS INTRODUCED:
 
225 ILCS 65/20-40

    Amends the Nursing and Advanced Practice Nursing Act. Increases the amount of moneys in the Nursing Dedicated and Professional Fund to be appropriated to the Department of Public Health for nursing scholarships awarded pursuant to the Nursing Education Scholarship Law from $750,000 to $1,500,000 for the fiscal year beginning July 1, 2004 and each fiscal year thereafter. Effective immediately.

1     AN ACT concerning nursing.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Nursing and Advanced Practice Nursing Act is
5 amended by changing Section 20-40 as follows:
 
6     (225 ILCS 65/20-40)
7     (Section scheduled to be repealed on January 1, 2008)
8     Sec. 20-40. Fund. There is hereby created within the State
9 Treasury the Nursing Dedicated and Professional Fund. The
10 monies in the Fund may be used by and at the direction of the
11 Department for the administration and enforcement of this Act,
12 including but not limited to:
13         (a) Distribution and publication of the Nursing and
14     Advanced Practice Nursing Act and the rules at the time of
15     renewal to all persons licensed by the Department under
16     this Act.
17         (b) Employment of secretarial, nursing,
18     administrative, enforcement, and other staff for the
19     administration of this Act.
20         (c) Conducting a survey, as prescribed by rule of the
21     Department, once every 4 years during the license renewal
22     period.
23         (d) Conducting of training seminars for licensees
24     under this Act relating to the obligations,
25     responsibilities, enforcement and other provisions of the
26     Act and its rules.
27         (e) Disposition of Fees:
28             (i) (Blank).
29             (ii) All of the fees and fines collected pursuant
30         to this Act shall be deposited in the Nursing Dedicated
31         and Professional Fund.
32             (iii) For the fiscal year beginning July 1, 1988,

1         the moneys deposited in the Nursing Dedicated and
2         Professional Fund shall be appropriated to the
3         Department for expenses of the Department and the Board
4         in the administration of this Act. All earnings
5         received from investment of moneys in the Nursing
6         Dedicated and Professional Fund shall be deposited in
7         the Nursing Dedicated and Professional Fund and shall
8         be used for the same purposes as fees deposited in the
9         Fund.
10             (iv) For the fiscal year beginning July 1, 2004
11         2001 and for each fiscal year thereafter, $1,500,000
12         $750,000 of the moneys deposited in the Nursing
13         Dedicated and Professional Fund each year shall be set
14         aside and appropriated to the Illinois Department of
15         Public Health for nursing scholarships awarded
16         pursuant to the Nursing Education Scholarship Law.
17         Representatives of the Department and the Nursing
18         Education Scholarship Program Advisory Council shall
19         review this requirement and the scholarship awards
20         every 2 years.
21             (v) Moneys in the Fund may be transferred to the
22         Professions Indirect Cost Fund as authorized under
23         Section 2105-300 of the Department of Professional
24         Regulation Law (20 ILCS 2105/2105-300).

26     Section 99. Effective date. This Act takes effect upon
27 becoming law.
