AMENDMENT TO HOUSE BILL 1261

2     AMENDMENT NO. ______. Amend House Bill 1261, AS AMENDED, by
3 replacing everything after the enacting clause with the
4 following:
 
5     "Section 5. The Local Government Consolidation Commission
6 Act is amended by changing Section 25 as follows:
 
7     (20 ILCS 3986/25)
8     Sec. 25. Report. The Commission shall render its final
9 report to the General Assembly not later than December 31, 2007
10 2006, setting out its findings and recommendations and
11 proposing those measures it considers necessary to effect
12 essential changes and improvements in the existing laws
13 relating to any or all of the matters enumerated in Section 10
14 of this Act.

16     Section 10. The Illinois Municipal Code is amended by
17 changing Section 1-7-2 as follows:
 
18     (65 ILCS 5/1-7-2)  (from Ch. 24, par. 1-7-2)
19     Sec. 1-7-2. Whenever in this Code any provision thereof is
20 based upon the number of inhabitants, the number of inhabitants
21 of the municipality shall be determined by reference to the
22 latest census taken by authority of the United States or this

1 state, or of that municipality. It is the duty of the Secretary
2 of State, upon the publication of any state or United States
3 census or the certification of any municipal census referenced
4 under Section 1-7-1, to certify to each municipality the number
5 of inhabitants, as shown by that census. In the event that a
6 partial census is conducted pursuant to Section 1-7-1, the
7 Secretary of State shall certify the total number of
8 inhabitants of the municipality as the number reflected by the
9 last complete census of the municipality adjusted by the net
10 increase or decrease reflected by the partial census. And the
11 several courts in this state shall take judicial notice of the
12 population of any municipality, as the population appears from
13 the latest federal, state, or municipal census so taken,
14 certified, and adjusted.

16     Section 99. Effective date. This Act takes effect upon
17 becoming law.".
